Resolution 8855 1 RESOLUTION NO. 8855
WHEREAS, a wall has heretofore been erected upon
the westernmost portion of Lot 6 of Indian Beach Corpora-
tion' s Subdivision, according to the plat thereof, record-
ed in Plat Book 8, Page 61, of the Public Records of Dade
County, Florida, and
WHEREAS, a recent survey prepared by the City
Engineer, a copy of which is hereto attached, reveals that
the wall so erected encroaches upon the public highway
(Collins Avenue ) approximately two (2 ' ) feet, and
WHEREAS, it is the opinion of the City Council
that the said encroachment was unintentional;
NOW, THEREFORE, BE IT RESOLVED by the City Coun-
cil of the City of Miami Beach, Florida that insofar as
said City Council has the power to bind the City of Miami
Beach in the premises, no action of any kind whatsoever
shall be taken by the said City within five (5) years from
the date of this resolution to require the owner of the
said property, or her heirs, successors or assigns to move
or to remove the portion of said wall which now encroaches
upon said public street as aforesaid.
