A RESOLUTION OF THE MA YORAND CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING THE
CITY MANAGER, PURSUANT TO THE BEACHFRONT
MANAGEMENT AGREEMENT BY AND BETWEEN THE CITY
OF MIAMI BEACH AND THE STATE OF FLORIDA, AND IN
ACCORDANCE WITH FLORIDA STATUTES, TO PROVIDE
INPUT FOR THE CITY'S SUBMITTAL OF AN UPDATE TO THE
CITY'S BEACHFRONT MANAGEMENT PLAN TO THE STATE
OF FLORIDA; ALSO, SPECIFICALLY APPOINTING A MEMBER
OF THE CITY COMMISSION TO SERVE ON THE ADVISORY
GROUP, IF NECESSARY, AND IF REQUIRED, PURSUANT TO
SECTION 259.032(B) OF THE FLORIDA STATUTES
WHEREAS, on February 3, 1982, the City of Miami Beach (City) entered into
Management Agreement No. 750-0006 (renumbered 3595) with the Board of Trustees of
the Intemallmprovement Trust Fund of the State of Florida (State) forthe management of
the beach property from Government Cut to 87'h Terrace for recreational and other related
activities; and
WHEREAS, said Management Agreement was for a period of twenty five (25) years
and required the City to submit a beachfront management plan pursuant to Section
253.034(4), Florida Statute; and
WHEREAS, the State also requires the City to submit an updated beachfront
management plan every five (5) years; and
WHEREAS, on January 8, 2003, the Administration presented the City Commission
with a status report that included the City's submittal of an updated beachfront
management plan; and
WHEREAS, in response to said submittal, the Department of Environmental
Protection (DEP) has taken the position that, if required pursuant to Section
259.032(1 O)(b), Florida Statute, which provides that individual management plans shall be
developed for parcels of over 160 acres, with input from an advisory group; and
WHEREAS, the City is in the process of conducting a survey to determine the
number of acres of beach property governed by Management Agreement No. 3595; and
WHEREAS, if an advisory group needs to be appointed, its composition must be in
accordance with the classifications delineated in said Florida Statute; and
WHEREAS, one of the delineated classifications of the advisory group is a local
elected official.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission approve a Resolution authorizing the City Manager, pursuant to the
Beachfront Management Agreement by and between the City of Miami Beach and the
State of Florida, and in accordance with Florida Statutes, to provide input for the City's
submittal of an update to the City's Beachfront Management plan to the State of Florida;
also, specifically appointing a member of the City Commission to serve on the advisory
group, if necessary, and if required, pursuant to Section 259.032(b) of the Florida Statutes.

Re: Management Plan for Beachfront Lands in the City of Miami Beach (#3595)
Dear Mr. Damien:
Thank you for your letter of January 20, 2003 asking for clarification of the requirement
for the development of management plans for use of state owned property. This is also a
follow up to our phone conversation on January 24,2003. As you recall I stated during
our conversation that Florida Statute 253.034(5) require" Each entity managing
conservation lands shall submit to the Division of State Lands a management plan at least
every 5 years in a form and manner prescribed by rule by the board".
Also Florida Statute 259.032(1O)(b) states in part" individual management plans required
by s. 253.034(5), for parcels over 160 acres, shall be developed with the input from an
advisory group". Please refer to 259.032(1O)(b) for direction on the make-up of the
advisory group.

The Administration recommends that the City Commission approve the Resolution.
ANALYSIS
On February 3, 1982, the City of Miami Beach (City) entered into Management Agreement
No. 750-0006 (renumbered 3595) with the Board of Trustees of the Internal Improvement
Trust Fund of the State of Florida (BTIITF) for the management of the beach property from
Government Cut to 87th Terrace for recreational and other related activities. Said
Management Agreement was for a period of twenty five (25) years and required the City to
submit a beachfront management plan pursuant to Section 253.034(4), Florida Statute.
The 1981 Florida Statute (as supplemented in 1982), provided that "Each state agency
managing lands.. .submit a land-management plan.. .at least every 5 years..." It appears
that the intent of the BTIITF was that that City comply with said Section as if it were the
state agency.
In 1999 the State Legislature (via HB 1039) amended Section 253.032 (10) as follows:
"...management plans required by s. 253.034(5) 253.031 (1)..."
In 2000 the Legislature (via HB 2403) amended the language in Section 253.034 (5) as
follows:
"Each state ageR6Y entity managing conservation lands shall
submit...a...plan at least every 5 years..."
The change of the words "state agency" and "agency", to "entity" appeared to be consistent
throughout the statute and thereby clarifying the City's role in submittal of the plan.
Additionally, the beaches are considered "conservation lands" from the State perspective.
Section 259.032 (10) of the 1997 Florida Statute provided that "Beginning fiscal year 1998-
1999, individual management plans required by Section 253.034 (4), Florida Statute, shall
be developed with input from an advisory group." Section 259,032 10 (b), of the 2002
Florida Statute, now reads "...Iocal governmental agencies...designated to manage
lands...shall be developed with input from an advisory group." Since the City's last
submittal was in 1997, the "advisory group" requirement did not take effect until fiscal year
1998-1999.
Section 259.032 (10) (b) of the 1997 Florida Statute also addressed the requirement for
lands that exceeded the 160 acres, but it was the responsibility of the State Division of
Lands to submit a copy of the plan to the Land Management Advisory Council for their
review, which in turn would submit recommendations (e.g. approval, modification, rejection)
to the BTIITF. The City has been unable to confirm whether that occurred or not.
However, the City never received notification that the plan had been rejected and/or
required modification implies that it was accepted as submitted.
On January 8, 2003, the Administration presented the City Commission with a status report
that included the City's submittal of an updated beachfront management plan. In response
to said submittal, the Department of Environmental Protection (DEP) responded with the
attached correspondence and has taken the position that as required pursuant to Section
259.032(10)(b), Florida Statute, which provides that individual management plans for
parcels of over 160 acres shall be developed with input from an advisory group.
The City is in the process of conducting a survey to determine the number of acres of
beach property governed by Management Agreement No. 3595. If an advisory group
needs to be appointed, its composition must be in accordance with the classifications
delineated in said Florida Statute. One of the delineated classifications of the advisory
group is a local elected official. Said classifications, along with the Administration's
recommendations are as follows:
Lead Land Managing Agency - City of Miami Beach - City Manager Designee
Co-Managing Entities - Miami-Dade County Parks Director
Local Private Property Owners - TBD
Soil and Water Conservation District - Florida Water Management District - TBD
Local Conservation Organization - TBD
Local Elected Official - TBD
On March 19, 2003, an agenda item, informing the Mayor and City Commission of the
advisory group requirement, was discussed. The City Commission voted to defer the item
and instructed the Administration to develop a list of potential nominees, by category, for
the following City Commission meeting. Attached are lists of potential nominees for the two
categories of "Local Private Property Owners" and "Local Conservation Organization". For
the category of "Local Private Property Owners" the corresponding lists include the names
of condominiums and hotels with beach concession operations, as well as, a list of civic
organizations that represent some of these properties. For the category of "Local
Conservation Organization", the corresponding list contains the names of the members of
Beach Preservation Committee and Marine Authority.
In accordance with the respective statute "the advisory group shall conduct at least one
public hearing within the county in which the parcel or project is located." "The area-wide
public hearing shall be held in the county in which the core parcels are located. Notice of
such public hearing shall be posted on the parcel or project designated for management,
advertised in a paper of general circulation, and announced at a scheduled meeting of the
local governing body before the actual public hearing. The management prospectus
required pursuant to paragraph (9)(d) of the Statute shall be available to the public for a
period of 30 days prior to the public hearing."
Once a plan is adopted, the managing agency or entity shall update the plan at least every
five (5) years in a form and manner prescribed by rule of the board of trustees. Such
updates, for parcels over 160 acres, shall be developed with input from an advisory group.
In summary, there is a five (5) year submission requirement, as well as, an advisory group
requirement, if the beach property/managed lands exceed 160 acres. The beach property
under the management agreement is estimated to be 227 acres.
Therefore, in accordance with the State's request, it is recommended that the Mayor and
City Commission adopt the attached resolution and appoint a City Commissioner to the
Advisory Group,
