Resolution 8961 RESOLUTION NO. 8961
WHEREAS, the City Council of the City of Miami
Beach deems it to be necessary to increase to One Hundred
Twenty-Five (125) feet the width of that portion of Collins
Avenue adjacent on the west to Lot 6, Indian Beach Corpora-
tion 's Subdivision, according to the Amended Plat thereof,
recorded in Plat Book 8, at page 61 of the Public Records
of Dade County, Florida, and
WHEREAS, in order to increase the width of Collins
Avenue as aforesaid, it will be necessary to acquire an ease-
ment for highway purposes over, under and across that certain
unnumbered out-lot" lying between Collins Avenue and Indian
Creek and opposite said Lot 6, as well as to acquire, bulk-
head and fill an additional submerged area in Indian Creek,
and
WHEREAS, the owner and mortgagee of said land have
indicated their willingness to deliver to the City deeds
conveying and releasing said unnumbered "out-lot" in con-
sideration of the agreement to be made by the City in connect-
ion therewith, and
WHEREAS, the City Attorney has prepared an agreement
setting forth the terms and conditions upon which said owner
and mortgagee will deliver said instruments, and
WHEREAS, the City Council deems it to be to the best
interest of the City to acquire said land on the terms and
in the manner set forth in the agreement,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF MIAMI BEACH, FLORIDA that the Mayor and the
City Clerk be and they are hereby authorized and directed to
execute said agreement in the name of and on behalf of said
City.
BE IT FURTHER RESOLVED that the City Manager and
the City Clerk be and they are hereby authorized and directed
to carry out the terms of said agreement for and in behalf of
said City and the disbursing officers of the City be and they
are hereby authorized and directed to make such expenditures
as the City is obligated to make under the terms of said agree-
ment from the funds of said City available for such purpose .
