Resolution 9093 RESOLUTION NO. 9093 WHEREAS, on or about the 7th day of March, 1954 the vessel "Winding Bay" ran aground on the south bank of the main channel, south of the Albury Warehouse on the Causeway Terminal, Miami Beach, Florida, causing the collapse of a water line belonging to the City of Miami Beach, Florida, and WHEREAS, the damage to said water line has been estimated by the employees of the City of Miami Beach at $1,483.69, and WHEREAS, a settlement of the claim of the City has been offered by representatives of the vessel "Winding Bay" , said representatives offering to the City $1,038.58 in full settlement of the claim, and WHEREAS, it is deemed to be to the best interest of the City to accept said offer of settlement, and WHEREAS, the City Attorney has prepared a release of all claims against the said vessel "Winding Bay" , or the owners thereof, for the said damages . NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Miami Beach that the Mayor and the City Clerk be and they are hereby authorized to execute said release, with the contents of which said City Council is familiar, in the name of and on behalf of said City. BE IT FURTHER RESOLVED that the City Manager be and he is authorized and directed to deliver said release upon the receipt of $1,038.58 for the City.
