Resolution 9094 RESOLUTION NO. 9094
WHEREAS, ALFRED W. HARP, JR., an employee
of the Police Department of the City of Miami Beach,
Florida was injured on May 26, 1952 in the course of
his employment by a third party; and
WHEREAS, the employee recovered a judgment
against the third party tort feasor in the case of "Alfred
W. Harp, Jr., individually and as employee for the use and
benefit of the City of Miami Beach, a Municipal corporation
organized and existing under the Laws of the State of
Florida, Plaintiff vs. Olin 's, Inc ., a Florida Corporation and
George S. Carter, Defendants", in the Circuit Court of the
Eleventh Judicial Circuit of Florida in and for Dade County,
Case No. 27766, which judgment is recorded in Minute Book
235, page 168 of the Public Records of Dade County, Florida;
and
WHEREAS, under the provisions of the Workmen's
Compensation Law of the State of Florida, the Court did enter
an order of pro rata distribution to the City of Miami Beach,
which order is recorded in Minute Book 270, at page 235 of
the Public Records of Dade County, Florida; and
WHEREAS, the City Attorney has prepared a
satisfaction of judgment, with the contents of which the
City Council is familiar;
NOW, THEREFORE, BE IT RESOLVED by the City
Council of the City of Miami Beach, Florida that the Mayor
and the City Clerk be and they are hereby authorized and
directed to execute a satisfaction in behalf of the City
of Miami Beach for its pro rata share of the judgment
recovered by the employee, ALFRED W. HARP, JR. , in Case No. 2766
in the Circuit Court of the Eleventh Judicial Circuit, Dade
