Resolution 9128 RESOLUTION NO. 9128
WHEREAS, the City Council of the City of Miami
Beach, Florida deems it necessary to lease from the
owner thereof the following described property, to wit :
The southerly twelve (12) feet
of Lot Four (4 ) , less the northeast
sixty-six (66) feet of Block Twenty-
two (22) , Resubdivision of Lots
Thirty-eight and Thirty-nine (39) ,
Block Ten (10) of BISCAYNE BEACH
SUBDIVISION, according to the Plat
thereof as recorded in Plat Book 48,
page 53 of the Public Records of
Dade County, Florida;
for the purpose of enabling the City to construct and
maintain a temporary footbridge thereon, together with
approaches thereto, for the use of the public , for a
term commencing on August 24, 1955 and ending on
December 2, 1955, with an option in the City to renew
the said lease for an additional one month period; and
WHEREAS , the owner of the said land is willing
to lease the same at a rental of One Hundred ($100.00)
Dollars per month provided, however, that in addition
thereto, the City shall restore the existing shrubbery
and landscaping; and
WHEREAS, the City Attorney has prepared a lease
agreement setting forth the terms and conditions of said
lease , and the City Council being familiar with the terms
and provisions thereof;
NOW, THEREFORE, BE IT RESOLVED by the City
Council of the City of Miami Beach, Florida, that the Mayor
and the City Clerk be and they are hereby authorized and
directed to execute said lease agreement in the name of and on
behalf of said City.
BE IT FURTHER RESOLVED that the City Manager
and the City Clerk be and they are hereby authorized and
directed to carry out the terms of said lease agreement
for and in behalf of said City, and the disbursing officers
of the City be and they are hereby authorized and directed
to pay out such sums of money as the City is obligated to
pay out under the terms of said lease agreement, from the
funds of said City available for such purpose .
