Resolution 9130 RESOLUTION NO. 9130
WHEREAS, the City Council of the City of Miami
Beach, Florida deems it necessary to lease from the owners thereof,
SAMUEL LARISCH and RUTH LARISCH, his wife, the following described
property, to wit :
The easterly thirty (30) feet of Lot 1 ,
less the northerly seventy-five (75)
feet thereof of Block l4, BISCAYNE POINT
SUBDIVISION, according to the Plat thereof,
recorded in Plat Book 14, page 35 of the
Public Records of Dade County, Florida;
and to lease from the owners thereof, SAMUEL C . GRUSHOFF and
IDA GRUSHOFF, his wife, the following described property, to wit :
The southerly ten (10) feet of Lot 27,
less the easterly one hundred and twenty
(120) feet thereof, Block 17, BISCAYNE
POINT SUBDIVISION, according to the Plat
thereof as recorded in Plat Book 14, page
35 of the Public Records of Dade County,
Florida;
for the purpose of enabling the City to construct and maintain
a temporary footbridge thereon, together with approaches thereto,
for the use of the public , for terms commencing on the 9th day
of September, 1955 and ending on the 9th day of January, 1956,
with an option in the City to renew the said leases for an additional
one month period; and
WHEREAS . each of the owners of the said land
is willing to lease the said property at a rental of One Hundred
($100.00) Dollars per month provided, however, that in addition
thereto, the City shall restore the existing shrubbery and
landscaping; and
WHEREAS the City Attorney has prepared lease
agreements setting forth the terms and conditions of said leases ,
and the City Council being familiar with the terms and provisions
thereof;
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Miami Beach, Florida, that the Mayor and the City
Clerk be and they are hereby authorized and directed to execute
said lease agreements in the name of and on behalf of said City.
BE IT FURTHER RESOLVED that the City Manager and
the City Clerk be and they are hereby authorized and directed to
carry out the terms of said lease agreements for and in behalf of
said City, and the disbursing officers of the City be and they
are hereby authorized and directed to pay out such sums of money as
the City is obligated to pay out under the terms of said lease
agreements, from the funds of said City available for such purpose .
