Resolution 9170 RESOLUTION NO. 9170
WHEREAS, in connection with the widening of that
portion of Indian Creek Drive whidiconstitutes the
northern approach to the 41st Street Bridge, the Alamo
Hotel. Corp. conveyed to the City of Miami Beach those
certain "out-lots" lying between Indian Creek Drive and
Indian Creek, opposite Lots 15 and 16, Block 38 of the
Ocean Front Property of the Miami Beach Improvement
Company, and in consideration thereof, the said City
obtained from the Trustees of the Internal Improvement
Fund of the State of Florida for said Alamo Hotel Corp.
a strip of submerged land. in Indian Creek of approximately
the same area as the said "out-lots" ; and
WHEREAS, simultaneously therewith the City
procured a deed From the said Trustees by the terms of
which there was conveyed to said City an additional
parcel of submerged land; and
WHEREAS, a recent examination of the Abstract of
Title setting forth said conveyances has caused the
examining attorney to believe that the description
contained in the said conveyance from the Trustees to
the City included some portion of the submerged area
which had been conveyed, as aforesaid, by the Trustees
to Alamo Hotel Corp. ; and
WHEREAS, Alamo Hotel Corp. has requested the City
of Miami Beach to execute and deliver to it a quit-claim
deed covering that portion of said submerged area which was
conveyed by the said Trustees to Alamo Hotel Corp; and
WHEREAS, the City Attorney has prepared a quit-
claim deed pursuant to the request of said Alamo Hotel
Corp. , with the terms of which the City Council is
familiar;
NOW, TIFEREFORE, BE IT RESOLVED by the City Council
of the City of Miami Beach, Florida, that the Mayor
and the City Clerk be and they are hereby authorized and
u._rec ped to execute and deliver said quit-claim deed in the
name of and on behalf of said City.
