Resolution 9431 RESOLUTION NO . 9431
WHEREAS, the owners of the fee simple title
in and to those certain parcels of land situate in Dade County,
Florida and described as follows:
Lots 5 and 6, Block 48 of
LINCOLN SUBDIVISION, according
to the plat thereof recorded
in Plat Book 9 at page 69
of the public records of Dade
County, Florida
have offered to sell the same to the City of Miami Beach
for the sum of 462,500.00; and
WHEREAS, the said land is subject to a 99 year
lease heretofore entered into by said owners as Lessors; and
WHEREAS, the Lessee under said lease has offered to
assign, transfer and set over unto the City of Miami Beach
all of its right, title and interest in and to the said property
for the sum of 423,898.25; and
WHEREAS, the said owners have agreed that if
their offer is accepted by said City, then and in that event a
w5, 000.00 deposit held by said owners as security under the
terms of said lease will be returned to the Lessee; and
WHEREAS, the City Council of the City of Miami Beach,
Florida deems it to be for the best interests of said City to
acquire said land at the prices so offered for the purpose of
off the street parking of automobiles; and
WHEREAS, the attorney for the City has prepared
an agreement embodying the details of said transaction, and
the City Council being familiar with the contents thereof;
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Miami Beach, Florida that the Mayor and the
City Clerk be, and they are hereby authorized and directed to
execute said agreement in the name of and on behalf of said
City.
BE IT FURTHER RESOLVED that the disbursing
officers of said City be and they are hereby authorized and
directed to make the disbursements required by the terms of said
agreement from funds of said City available for such purpose .
