RESOLUTION NO . 95624
WHEREAS, LILLIAN GAPINSKI was first employed in the
Police Department of the City of Miami Beach on the 16th day of
December, 1947 and remained in such employment until April 30,
1948 and, thereafter, said Lillian Gapinski was employed at various
times for periods of various lengths until April 30, 1954, at which
time she was laid off, but was not placed on a re-employment list
and has never been employed bj the City since said date; and
WHEREAS, thereafter, on May 16th, 1954, another person
was employed as a policewoman in her stead; and
WHEREAS, said Lillian Gapinski, in a suit in the Circuit
Court of Dade County, Florida obtained a decree which has been
affirmed by the Supreme Court of Florida; and
WHEREAS, said decree contained, among other things, an
order that "the plaintiff be paid wages for all periods during
which the services of a policewoman were utilized by the City
subsequent to April 30th, 1954 up to the date of her re-employment",
and a further order that the Personnel Board of the City of Miami
Beach "forthwith place upon the re-employment list the name of
the plaintiff and shall certify the name of the plaintiff for
such re-employment"; and
WHEREAS, said Lillian Gapinski has agreed to waive the
benefits from that part of the decree which provides for placing
her name upon the re-employment list and certifying her for re-
employment; and
WHEREAS, the wages prescribed by the ordinances of the
City of Miami Beach for the classification of policewoman have,
continuously since the 16th day of May, 1954 been 43337 .00 per month
for the first year; $359.00 per month for the second year; $375.00
per month for the third year; and $392.00 per month for the fourth
year;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Miami Beach, Florida that the disbursing officers of
said City be and they are hereby authorized and directed to pay to
said Lillian Gapinski wages for the period extending from May 16,
1954 to the date of such payment at the rate of 5337 .00 per month
for the year ending May 15, 1955; at the rate of 5359.00 per month
for the year ending May 15, 1956; at the rate of $375.00 per month
for the year ending May 15, 1957; and at the rate of 5392.00 per
month for the period commencing May 16th, 1957 and extending to
the date of payment.
