Resolution 9565 RESOLUTION NO . 9565
WHEREAS, GRACE E. WEICHELT was first employed in the
Police Department of the City of Miami Beach on the 19th day of
December, 1949 and remained in such employment until the 15th
day of April, 1950 and, thereafter, said Grace E. Weichelt was
employed at various times for periods of various lengths until
April 30th, 1954, at which time she was laid off, but was not placed
on a re-employment list and has never been employed by the City
since said date; and
WHEREAS, thereafter, on December 22nd, 1954, another person
was employed as a policewoman in her stead; and
WHEREAS, said Grace E. Weichelt, in a suit in the Circuit
Court of Dade County, Florida obtained a decree which has been
affirmed by the Supreme Court of Florida; and
WHEREAS, said decree contained, among other things, an
order that "the plaintiff be paid wages for all periods during
which the services of a policewoman were utilized by the City
subsequent to April 30th, 195L up to the date of her re-employment" ,
and a further order that the Personnel Board of the City of Miami
Beach "forthwith place upon the reemployment list the name of
the plaintiff and shall certify the name of the plaintiff for such
re-employment"; and
WHEREAS, the wages prescribed by the ordinances of the
City of Miami Beach for the classification of policewoman have,
continuously since December 22nd, 1954,been $337 .00 per month for
the first year; 8359.00 per month for the second year; and 5375.00
per month for the third year;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Miami Beach, Florida that the disbursing officers of said
City be and they are hereby authorized and directed to pay to said
Grace E. Weichelt wages for the period extending from December 22nd,
1954 to the date of her re-employment as a policewoman at the rate of
6337 .00 per month for the year ending December 21, 1955; at the
rate of S359.00 per month for the year ending December 21, 1956;
and at the rate of 375.00 per month for the period commencing
December 22nd, 1956 and ending on the date of the re-employment
of said Grace E. Weichelt by said City as a policewoman.
