Resolution 9572 RESOLUTION NO. 9572
WHEREAS the City of Miami Beach, Florida, heretofore,
to wit, on April 11, 1955, did sell, assign and deliver to
Arthur S. Lavine that certain tax sale certificate of the City of
Miami Beach, Florida, being numbered 13 and dated the 5th day of
July, 1954 and recorded in Tax Sale Book 25 on page 1 of the
Public Records of Dade County, Florida, in the sum of $265.95,
covering the following described property, to wit:
Lot 11 and Ni of Lot 10, Block 1, Rivo Alto Island,
according to the Plat thereof recorded in
Plat Book 7 at page 74 of the Public Records
of Dade County, Florida; and 8-foot strip
contiguous to westerly boundary of Lot 11 and
Ni of Lot 10.
and
WHEREAS the said Arthur S. Lavine has duly made and
filed an affidavit with the City Clerk of the City of Miami Beach,
setting forth that the said tax sale certificate has been lost or
destroyed and that he has made diligent search therefor and has
been unable to locate or find said tax sale certificate and that
neither the said tax sale certificate nor any interest thereon has
been hypothecated, sold, assigned, transferred or delivered by him,
and
WHEREAS the said Arthur S. Lavine has delivered unto the
City of Miami Beach, Florida, his bond payable to the City of Miami
Beach, Florida, in the sum of $647.16, said amount being double
the amount of the present value of the said tax sale certificate
whereby the said obligor agrees to indemnify and save harmless the
City of Miami Beach, Florida, from any loss which it may incur in
consequence of the issuance of a duplicate tax sale certificate, and
WHEREAS the said Arthur S. Lavine has agreed to surrender
the said duplicate tax sale certificate to the Clerk of the Circuit
Court in and For Dade County, Florida, in the event that the original
thereof shall be found,
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COUNCIL
OF THE CITY OF MIAMI BEACH, FLORIDA, that the Tax Collector of the
City of Miami Beach, Florida be and he is duly authorized and directed
to execute, issue and deliver to the said Arthur S. Lavine a duplicate
of the original of said tax sale certificate number 13, 1953, and
that the said Arthur S. Lavine be and he is authorized and empowered
to attach to said duplicate tax sale certificate a duly certified
copy of this Resolution as proof of the authority of the said City
Tax Collector to issue unto him, the said Arthur S. Lavine, the said
duplicate tax sale certificate.
PASSED AND ADOPTED this 7th day of August, A.D. 1957.
