Resolution 9587 RESOLUTION NO. 9587 WHEREAS, the City Attorney of the City of Miami Beach has been called upon to act in a dual capacity, inasmuch as he represents the department heads in all hearings on appeals from disciplinary action, and at the same time advises the Personnel Board on all matters pertaining to the duties of said Board including the method of conducting said hearings and the rulings to be made on points of law and procedure, and WHEREAS, in the opinion of the City Council the interests of all parties would be better served, and the true intent of the Civil Service Act be better attained, if the Personnel Board had assigned to it special counsel, and WHEREAS, after due consideration of the foregoing, the City Council of the City of Miami Beach deems it to be to the best interest of said City to employ special counsel to confer with and to advise the Personnel Board of said City and to attend the meetings of said Personnel Board as well as all hearings on appeals from disciplinary action in order that the Personnel Board may at all times have available the advice of said special counsel, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Miami Beach, that James H. Ruby, Attorney at Law, of said City, be and he is hereby employed as special counsel for the Personnel Board of said City, with the duties hereinbefore set forth, at a compensation hereby fixed at $150.00 per month, payable in semi- monthly payments, said employment to commence immediately and to be subject totermination at the will of either party.
