Resolution 9594 RESOLUTION NO. 9594
WHEREAS, the City of Miami Beach has heretofore entered
into an agreement for the purchase of that certain parcel of
land situate in the City of Miami Beach, Dade County, Florida,
described as follows, to wit :
The North 26 feet of Lot 9, all
of Lots 10 and 11, and Lot 12
• less the North 5 feet, Block 2,
FRIEDMAN & COPE SUBDIVISION OF
EDMUND WILSON TRACT, according
to the plat thereof, recorded in
Plat Book 4+, page 83 of the public
records of Dade County, Florida;
and
WHEREAS, a portion of said land is encumbered by an
existing leasehold estate, held and owned by one Israel
Reiman, the term of which expires on October 1, 1959; and
WHEREAS, in order to extinguish said leasehold interest,
it would be necessary to institute condemnation proceedings;
and
WHEREAS, the said lessee is willing and has offered to
sell, transfer and assign his leasehold interest to the
City for the sum of $2500.00, and deliver possession of said
premises on or before November 15, 1957; and
WHEREAS, the City Council of the City of Miami Beach
deems it to be to the best interest of the City that the said
offer be accepted; and
WHEREAS, the City Attorney has prepared an agreement
setting forth the terms and conditions upon which said leasehold
shall be acquired, and with which the City Council is familiar;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF MIAMI BEACH, FLORIDA that the Mayor and the City
Clerk be and they are hereby authorized and directed to
execute the said agreement in the name of and on behalf of
said City, and the City Manager be and he is hereby authorized
and directed to consummate the transaction contemplated hereby,
and the disbursing officers of the City are hereby authorized
and directed to make the expenditures required to comply with
the terms of said agreement out of the funds of the City
available for such purpose .
