Resolution 2018-30455 RESOLUTION NO. 2018-30455 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ADOPTING THE CERTIFICATION OF THE MIAMI-DADE COUNTY CANVASSING BOARD FOR THE AUGUST 28, 2018 SPECIAL ELECTION FOR THE CITY OF MIAMI BEACH, AND DECLARING THE RESULTS THEREOF. WHEREAS, the Certification of the results of the August 28, 2018 City of Miami Beach Special Election has been received from the Miami-Dade County Supervisor of Elections, is attached hereto as Composite Exhibit"A," and is incorporated herein; and WHEREAS, said Certification reflects that Question "A" as set forth below was approved by the electorate of the City of Miami Beach'; and Question "B" as set forth below was not approved by the electorate of the City of Miami Beach. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Miami-Dade County Canvassing Board having canvassed the returns of the August 28, 2018 Special Election of the City of Miami Beach, the Mayor and City Commission hereby adopt the Certification of the Miami-Dade County Canvassing Board for said Special Election, and it is hereby ordered that the Certification and this Resolution be recorded in the After Action minutes of the September 12, 2018 City Commission meeting as a permanent record of the results of said Special Election; and be it further resolved that, as a result of the City of Miami Beach August 28, 2018 Special Election, the votes upon the questions presented reflect the following final results: QUESTION "A": Amending Composition of the Board of Adjustment Section 2 of the City's Related Special Acts establishes the Board of Adjustment ("BOA") with seven members, each representing one of the following professions: Law, architecture, engineering, real estate development, certified public accounting, financial consultation, and general business. Shall Section 2 be amended to provided that two of the BOA members shall be "citizens at-large" (no specific profession), and the remaining five members shall each represent one of the above professions? YES 6 733 64.67% NO 3 679 35.33% ' The two ballot questions have been lettered"A"and"B"for ease of reference herein only and were not so lettered on the ballot. QUESTION "B": Amend City Charter to Increase the Annual Compensation of the Mayor and City Commissioners Shall City Charter Section 2.02 be amended to change the annual compensation established in 1966, which has not been raised in 52 years, for the Mayor from $10,000 to $75,636, and for City Commissioners from $6,000 to $45,381; and also to authorize the City Commission, at a noticed public hearing, to allow an annual compensation increase based upon the Consumer Price Index, issued by U.S. Department of Labor, not to exceed three percent per year? ANALYSIS Attached hereto is a Resolution adopting the Certification of the Miami-Dade County Canvassing Board for the August 28, 2018 Special Election for the City of Miami Beach, and declaring results thereof. The Miami-Dade County Supervisor of Election's Certification of the results is attached to the Resolution and, upon the City Commission's acceptance thereof via passage of this Resolution, all City Commission election activities related to the City's August 28, 2018 Special Election shall be concluded [1].
