A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, RECOGNIZING AND
APPROVING EARLY VOTING FOR THE NOVEMBER 6, 2018 CITY
OF MIAMI BEACH SPECIAL ELECTION.
WHEREAS, the City of Miami Beach has scheduled a Special Election to be held on
Tuesday, November 6, 2018, in conjunction with the General Election, for the purpose of
presenting ballot questions to the City's electorate; and
WHEREAS, the City Commission hereby recognizes and approves Early Voting for the
November 6, 2018 City of Miami Beach Special Election; and
WHEREAS, in recognition of the 2013 statutory amendments to Section 101.657(1)(d)
Florida Statutes, which governs Early Voting, the City Commission hereby acknowledges that
each County's Supervisor of Elections is required to provide for Early Voting to begin on the 10th
day before an election that contains State or Federal races and end on the 3rd day before the
election; and providing Early Voting for no less than 8 hours and no more than 12 hours per day
at each site during the applicable period; in addition, Early Voting may be offered at the
discretion of the Supervisor of Elections on the 15th, 14th, 13t , 12th, 11th, or 2nd day before an
election that contains State or Federal races for at least 8 hours per day, but not more than 12
hours per day; and
WHEREAS, Florida's Election Code states that municipalities may provide Early Voting
only in municipal elections that are not held in conjunction with County or State elections;
therefore, the County will be responsible for conducting Early Voting activities related to the
City's November 6, 2018 Special Election; and
WHEREAS, the Miami-Dade County Supervisor of Elections has designated the following
Early Voting schedule for the November 6, 2018 City of Miami Beach Special Election, and has
designated Miami Beach City Hall, 1700 Convention Center Drive, and the North Shore Branch
Library, 7501 Collins Avenue, as the Early Voting locations within the City of Miami Beach:

WHEREAS, the Miami-Dade County Elections Department's final Early Voting schedule
and locations for the November 6, 2018 City of Miami Beach Special Election, is attached
hereto as Exhibit "A"; and
WHEREAS, the Miami-Dade County Elections Department has provided the City Clerk
with an estimate of approximately $31,000 for the City's November 6, 2018 Special Election,
which includes the costs associated with 14 days of Early Voting.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby recognize and approve Early Voting for the November 6, 2018 City of
Miami Beach Special Election, said Early Voting to be conducted in accordance with the
provisions of this Resolution.

SUBJECT:A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI
BEACH, FLORIDA, RECOGNIZING AND APPROVING EARLY VOTING FOR THE
NOVEMBER 6, 2018 CITY OF MIAMI BEACH SPECIAL ELECTION.
RECOMMENDATION
Approve a Resolution recogniang and approving early voting for the City of Miami Beach Special Election
to be held on Tuesday, November 6, 2018, in conjunction with the General Election.
ANALYSIS
During the July 25, 2018 City Commission meeting, the City Commission called for a Special Election to be
held on Tuesday, November 6, 2018, in conjunction with the General Election, in order to submit to the
electorate of the City of Miami Beach the following six ballot questions:
Question 1:
Establishing City of Miami Beach Office of Inspector General
Shall City Charter be amended to create the Office of Inspector General, which shall be independent and
empowered to:
• investigate, audit, review, and oversee municipal matters including City contracts, programs, projects, and
expenditures, in order to identify efficiencies, and detect, investigate, and prevent fraud, waste,
mismanagement, misconduct, and abuse of power; and
•subpoena witnesses, administer oaths, and require production of records;
provided such Office's appointment, term,functions, and powers shall be further established by ordinance?

Referendum Re: Use of Rent Payments Received By City from Convention Center Hotel Lease
If voters approve City's Convention Center Hotel lease with MB Mixed Use Investment, LLC, shall the City
adopt an ordinance dedicating the Hotel's guaranteed rent payments received by the City, to enhance
funding, in equal portions annually, for:
•stormvater projects(in lieu of rate increases),
•traffic reduction measures, and
•education,

Should City lease 2.6 acre property at northeast corner of 17th Street and Convention Center Drive to MB

•Construction/operation of 800 room Hotel (ma)imum height of 185 feet), connected to Convention Center,
• No City funding,
• No gambling,
• Rent to City after Hotel opens, including greater of: guaranteed rent ($16,616,242 over first ten years,
adjusted thereafter), or percentage of Hotel's revenues annually?

$169,000,000 General Obligation Bond issue to improve City's parks, recreational facilities and
cultural facilities
To improve the City's parks, recreational facilities, and cultural facilities, including playgrounds, baywalks,
beachwalks, waterways, landscaping, equipment, lighting, security, and parking related to such facilities,
shall the City be authorized to issue general obligation bonds, from time to time, not exceeding
$169,000,000 in aggregate principal amount, payable from unlimited ad valorem taxes, bearing interest not
exceeding the maximum legal interest rate, and maturing no later than 30 years from issuance date?

Question 5:
$198,000,000 General Obligation Bond issue to improve City's neighborhoods and infrastructure
To improve the City's neighborhoods and infrastructure, including stormvater and flooding mitigation
projects, sidewalk and street renovation and repairs, protected bicycle lanes, pedestrian paths, landscaping,
and lighting, shall the City be authorized to issue general obligation bonds, from time to time, not exceeding
$198,000,000 in aggregate principal amount, payable from unlimited ad valorem taxes, bearing interest not
exceeding the maximum legal interest rate, and maturing no later than 30 years from issuance date?

$72,000,000 General Obligation Bond issue for City police, fire, public safety, and security
improvements
To improve the City's police, fire, and public safety facilities, equipment, and technology, and to improve
lighting and security throughout the City, shall the City be authorized to issue general obligation bonds, from

time to time, not exceeding $72,000,000 in aggregate principal amount, payable from unlimited ad valorem
taxes, bearing interest not exceeding the maximum legal interest rate, and maturing no later than 30 years
from issuance date?

Section 101.657(1)(d), Florida Statutes, which governs Early Voting, requires that each County's
Supervisor of Elections commence early voting on the 10th day before an election that contains State or
Federal races and end on the 3rd day before the election; providing early voting for no less than 8 hours
and no more than 12 hours per day at each site during the applicable period. In addition, early voting may
be offered at the discretion of the Supervisor of Elections on the 15th, 14th, 13th, 12th, 11th, or 2nd day
before an election that contains State or Federal races for at least 8 hours per day, but not more than 12
hours per day.
Inasmuch as Florida's Election Code stales that municipalities may provide early voting only in municipal
elections that are not held in conjunction with County or State elections, the County will be responsible for
conducting the early voting activities related to the City's Special Election on November 6, 2018.
Accordingly, the Miami-Dade County Supervisor of Elections has designated the following early voting
schedule for the November 6, 2018 City Special Election, and has designated Miami Beach City Hall, 1700
Convention Center Drive, and the North Shore Branch Library, 7501 Collins Avenue, as the early voting
locations within the City of Miami Beach:

CONCLUSION
I recommend that the Mayor and City Commission recognize and approve early voting for the November 6,
2018 City of Miami Beach Special Election, said Early Voting to be conducted in accordance with the
provisions of the attached Resolution and Section 101.657, Florida Statutes.
FINANCIAL INFORMATION
The Mian-Dade County Elections Department has provided the City Clerk with an estimate of
approximately $31,000 to conduct the November 6, 2018 General Election, which includes the costs
associated with 14 days of Early Voting. (See Department of Election Estimate.)Additionally, the City will
incur approximately $31,100 in legally mandated advertisements, required by the Florida Statutes and the
City Code, to notice this Special Election.
