Resolution 2018-30465 RESOLUTION NO. 2018-30465 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING AND AUTHORIZING THE CITY OF MIAMI BEACH TO EXECUTE A NEW SOVEREIGNTY SUBMERGED LAND LEASE (BOT FILE NO. 130883466) BY THE CITY, AS LESSEE, AND THE BOARD OF THE INTERNAL IMPROVEMENT TRUST FUND OF THE STATE OF FLORIDA, AS LESSOR FOR A WATERMAIN CROSSING BETWEEN DILIDO ISLAND AND RIVO ALTO ISLAND OWNED BY THE CITY OF MIAMI BEACH; SAID LEASE HAVING A TERM OF FIFTY (50) YEARS, COMMENCING (RETROACTIVELY) ON FEBRUARY 7, 2016, AND ENDING ON FEBRUARY 7, 2066. WHEREAS, on February 7, 1986, the City of Miami Beach ("City") and the Board of Trustees of the Internal Improvement Trust Fund of the State of Florida ("Trustees") entered into Sovereignty Submerged Land Lease No. 26674 (3486-13), for a 12-inch watermain crossing across a parcel of sovereignty submerged land in Section 33, Township 53 South, Range 42 East in Biscayne Bay (the "Submerged Land Lease") between DiLido Island and Rivo Alto Island for a period of thirty (30) years; and WHEREAS, the Submerged Land Lease expired on February 7, 2016, and can therefore no longer be extended; and WHEREAS, a Submerged Land Lease is required to maintain and operate the 12-inch watermain crossing in its current location across sovereignty submerged land; and WHEREAS, the Administration negotiated a new fifty (50) year Submerged Land Lease with the State to continue to operate the existing watermain, a lease which will be retroactively applied from February 7, 2016 and end on February 7, 2066. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby approve and authorize the Administration to execute a new Sovereignty Submerged Land Lease (BOT File No. 130883466) by the City of Miami Beach, as Lessee, and the Board of Trustees of the Internal Improvement Trust Fund of the State of Florida, as Lessor, for a watermain crossing between DiLido Island and Rivo Alto Island; said lease having a term of fifty (50) years, commencing retroactively on February 7, 2016 and ending on February 16, 2066. The lease expired on February 7, 2016 and can therefore no longer be extended. A new sovereign submerged land lease is required to maintain and operate the 12-inch watermain crossing in its current location. The Administration negotiated a new 50-year submerged land lease with the State to continue to operate the existing watermain, a lease which will be retroactively applied from February 7, 2016 and end on February 7, 2066 (Attachment A). CONCLUSION The Administration recommends that the Mayor and City Commission adopt the resolution to execute a new Sovereignty Submerged Land Lease (BOT File No. 130883466) by the City of Miami Beach, as Lessee, and the Board of Trustees of the Internal Improvement Trust Fund of the State of Florida, as Lessor, for a watermain crossing between DiLido Island and Rivo Alto Island.
