Resolution 9680 RESOLUTION NO. 9680
WHEREAS, on the 20th day of November, 1957 the City
Council of the City of Miami Beach passed and adopted Resolution
No . 9637 authorizing and directing the Mayor and the City Clerk
to make, execute and deliver to the State Road Department a
certain "Utilities Agreement" for the adjustment, change or
relocation of certain utilities within the right-of-way limits
of State Road A-1-A, Section 8706; and
WHEREAS, pursuant to said Resolution, said agreement
was duly made, executed and delivered to the State Road Department,
and
WHEREAS, said agreement so executed and delivered had
deleted from the form of the proposed agreement desired by the
State Road Department the following provision:
"That in the event this work is done
simultaneously with the construction
of the project the City agrees to reimburse
the contractor directly for any just claim
due to delays caused by the City's operations,
or hinderance to the contractor 's efficient
prosecution of his work.
The City further agrees to make and enter
into a written agreement with the Department 's
successful bidder and file an executed copy
with the Department to provide as follows :
1. Covering procedure for coordinating
the work.
2. Minimization of delays .
3. Method of arriving at compensation
to contractor for delays occasioned
by City's operation. "
and
WHEREAS, the State Road Department objected to such
deletion and reiterated its desire that the City of Miami Beach
execute and deliver said agreement in its original form, and
WHEREAS the City Council of the City of Miami Beach
deems it to be to the best interests of the City of Miami Beach
that said request be granted,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and the City
Clerk be and they are hereby authorized and directed to make,
execute and deliver to the State Road Department said "Utilities
Agreement", in the form submitted and desired by the State Road
Department as aforesaid, for the adjustment, change or relocation
of certain utilities within the right-of-way limits of said State
Road A-1-A, Section 8706, and

BE IT FURTHER RESOLVED that a certified copy of this
Resolution be forwarded to the State Road Department in
Tallahassee, Florida.
PASSED AND ADOPTED this 15th day of January, A.D. 1958.
