RESOLUTION NO. 9725
WHEREAS, by Resolution No. 9718, the City Council of
the City of Miami Beach authorized the institution of condemnation
proceedings for the acquisition for park purposes of the following
land situate in Miami Beach, Dade County, Florida, to wit :
Lot numbered "Tract B" of HIBISCUS
ISLAND of the Biscayne Bay Islands
Company's Group, as per Plat recorded
in Plat Book 8, page 75 of the Public
Records of Dade County, Florida;
and
WHEREAS, pursuant to said Resolution appropriate
condemnation proceedings were instituted and are now pending
in the Dade County Circuit Court, and
WHEREAS, subsequent to the institution thereof, the
owner of said land has offered to sell and convey said land for
park purposes to the City of Miami Beach for the sum of $11,250.00,
said sum to be inclusive of her attorney's and appraiser 's fees,
and provided that said land will be conveyed subject to County and
City taxes without proration thereof, and with documentary stamps
to be at the expense of the City, and
WHEREAS, the City Attorney has prepared an agreement
setting forth the terms thereof as herein set forth, the City
Council being familiar with the terms thereof,
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COUNCIL
OF THE CITY OF MIAMI BEACH, that the Mayor and the City Clerk be
and they are hereby authorized and directed to execute said
agreement in the name of and on behalf of the City, and that upon
the consummation of said transaction, the City Attorney is hereby
authorized to dismiss said condemnation suit at the cost and
expense of the City of Miami Beach.
