Resolution 9794 RESOLUTION NO. 9794
WHEREAS, the Town of Bay Harbor Islands requires a
sewage collection and disposal service,and
WHEREAS the City of Miami Beach operates a sewage
collection and disposal service which has sufficient capacity
under suitable conditions to furnish sewage collection and
disposal services to neighboring territories, and
WHEREAS the City Council of the City of Miami Beach
deems it to be to the best interest of the City of Miami Beach
to enter into an agreement with the said Town of Bay Harbor
Islands, by the terms of which, for reasonable and sufficient
compensation, the Town of Bay Harbor Islands shall be permitted
to connect its sewer lines with the sewer lines of the City of
Miami Beach located within the boundaries of said City, and
WHEREAS the City Attorney has prepared an agreement,
with the terms of which the City Council is familiar, whereby
the Town of Bay Harbor Islands shall be permitted to connect
with and use the sewer lines of the City of Miami Beach for a
term of five years under the conditions set forth in said
agreement and shall pay: therefor the sum of $4,537.00 per annum
payable annually in advance, which shall be a minimum charge
under the agreement, and in addition thereto shall pay an amount
equal to 12¢ per thousand gallons of sewage passing through the
sewage system of the City of Miami Beach from the lands within
the corporate limits of the Town of Bay Harbor Islands, which
additional sum shall be payable monthly,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and the
City Clerk be and they are hereby authorized and directed to
execute the said agreement in the name of and on behalf of the
said City.
