RESOLUTION NO0 9917
WHEREAS, on the 16th day of October, 1958, the
City of Miami Beach, Florida, was the owner of the fee simple
title to certain lands situate in the City of Miami Beach,
County of Dade and State of Florida, now known as the Mt. Sinai
Hospital property, and formerly known as the Nautilus Veterans
Administration Hospital, which included Collins Island and
Johns Island, and
WHEREAS, on said 16th day of October, 1958, the
said City of Miami Beach conveyed all of said property to
Mt. Sinai Hospital of Greater Miami, Inc. , a non-profit Florida
corporation, and
WHEREAS, prior to said date the City of Miami Beach
had agreed (subject to the consent of the United States of
America through its Department of Health, Education and Welfare) ,
to convey to the State of Florida for the use of its State Road
Department for highway purposes, certain portions of the land
heretofore conveyed to Mt, Sinai Hospital of Greater Miami, Inc.,
as aforesaid, and
WHEREAS, simultaneously with the execution and
delivery of the instrument conveying title to Mt. Sinai Hospital
of Greater Miami, Inc. , as aforesaid, the said Mt. Sinai Hospital
of Greater Miami, Inc. executed and delivered its instrument to
the City of Miami Beach whereby it agreed to assume the obligation
of said City to convey to the State of Florida for highway purposes
as aforesaid and agreed to so convey without compensation,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF MIAMI BEACH, FLORIDA, that the City of Miami
Beach hereby declares and agrees that it will not receive or
accept any payments or compensation of any kind whatsoever for
the land acquisition by the State of Florida as hereinbefore
described or for severance damages in connection therewith.
