Resolution 9929 RESOLUTION NOo 9929
WHEREAS the City of Miami Beach has conveyed to the
Board of Public Instruction of Dade County, Florida, by warranty
deed, certain portions of what is commonly called the "Old
Municipal Golf Course" the portion so conveyed comprising five
acres more or less, and
WHEREAS, simultaneously with the execution and
delivery of said warranty deed, said City granted to said
Board of Public Instruction the right to use an additional
portion of said tract of land commonly referred to as the
"Old Municipal Golf Course", which portion comprises fifteen
acres more or less and
WHEREAS, litigation against said City has heretofore
been commenced and terminated and
WHEREAS there is now pending in the Circuit Court
of Dade County, Florida, a suit brought against said City
seeking to set aside the conveyance heretofore made by the
City to the School Board as aforesaid, and
WHEREAS it is possible that additional litigation
may be instituted questioning the right of the City to convey
or the right of the School Board to use the lands heretofore
conveyed as aforesaid, and
WHEREAS the City of Miami Beach has warranted the
title to the land so conveyed and the City Council of the City
of Miami Beach deems it to be the duty of said City to defend the
said title and the right of use by said School Board,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF MIAMI BEACH, that said City Council on behalf of
said City, hereby agrees that it will, at its own cost, defend
all suits which may be instituted which may question the title of
the lands conveyed as aforesaid or the right of the Board of
Public Instruction of Dade County, Florida to use said lands for
school purposes.
