Resolution 9930 RESOLUTION NO. 9930
WHEREAS the City Council of the City of Miami Beach
is considering amending Ordinance No. 289, commonly known as
"The 2,oning Ordinance of Miami Beach, Florida" , and the maps
attached thereto and made a part thereof, so as to exclude from
the "RE" Multiple-Family District and to include in the "BAAA"
Business District, and in an appropriate Area District, as said
districts are set forth and defined in said ordinance, that
certain parcel of land situate in Miami Beach, Dade County,
Florida, described as follows, to wit:
Lots 38, 39 and 40 of Block 3, of the Amended
Plat of SECOND OCEAN FRONT SUBDIVISION, and
the parcel of land westerly and adjacent thereto,
described as follows, to wit:
Begin at the southwesterly corner of Lot 38,
thence westerly along the southerly line of
said Lot 38 produced westerly for a distance
of 51 feet; thence northerly to the intersection
with the northerly line of Lot 39 extended
westerly 51 feet; thence northerly to the point
of intersection of the northerly line of Lot 40
extended westerly 50 feet; thence easterly along
the westerly extension of the said northerly line
of Lot 40, a distance of 50 feet to the westerly
boundary of Block 3; thence southerly along the
said westerly boundary of Block 3 to the point of
beginning;
Less the easterly 40 feet of Lots 38 and 39,
said 40 feet being measured at right angles to
the westerly line of Indian Creek Drive, and
less the easterly portion of Lot 40 described
as follows, to wit:
Begin at the point of intersection of the South
line of Lot 40 with the westerly line of Indian
Creek Drive, thence run westerly along the said
South line of Lot 40 a distance of 46.12 feet to
a point; thence northerly along a straight line to
a point on the North line of said Lot 40, said
point being 38.36 feet west of the West line of
Indian Creek Drive; thence easterly along the
North line of said Lot 40 a distance of 38.36 feet
to the West line of Indian Creek Drive; thence
southerly along the West line of Indian Creek Drive
to the Point of Beginning; recorded in Plat Book 28,
page 28 of the Public Records of Dade County, Florida;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF MIAMI BEACH, FLORIDA, that a public hearing be and
the same is hereby called to be held on the 7th day of January,
1959, at 11:30 o' clock a.m. , in the Council Chambers, City Hall,
Miami Beach, Florida, for the consideration of said amendment.

BE IT FURTHER RESOLVED that the City Clerk be and he
is hereby directed to give fifteen (15) days' notice of the time,
place and object of said hearing by Public Notice thereof, published
in the Miami Beach Sun, a newspaper of general circulation in said
City.
