Resolution 9932 RESOLUTION NO. 9932
WHEREAS the State Road Department in the construction
of the east approach to the 36th Street Causeway in the City of
Miami Beach did heretofore contemplate and plan the installation
of a certain storm drainage facility in connection therewith, and
WHEREAS the City of Miami Beach requested the State
Road Department to increase the size and dimensions of the
drainage pipe originally contemplated for use by the State Road
Department so as to provide additional drainage for an area
adjacent to said approach, thereby eliminating the necessity for
the City of Miami Beach to install an independent storm drainage
facility, and
WHEREAS the State Road Department has agreed to install
a drainage pipe of a capacity sufficiently greater to provide for
such additional drainage provided, however, that the City of
Miami Beach defray the additional cost and expense of the State
Road Department by acquiring at its own cost the necessary
easement for said storm drainage sewer, and
WHEREAS it will be financially advantageous to the
City of Miami Beach to agree to said condition and
WHEREAS the City Engineer has designated the location
for the said easement, the same being as hereinafter described,
and
WHEREAS the owners thereof are willing to grant an
easement thereon at a price of Fifty-five Hundred Dollars ($5,500 .00)
which is to include the right to use an additional forty (40) feet
of the land hereinafter described immediately adjacent to said
easement for construction purposes for a period of ninety (90) days,
and
WHEREAS the City Council deems it necessary to acquire
the said easement at the said consideration for the best interests
of the inhabitants of the City of Miami Beach,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF MIAMI BEACH, FLORIDA, that the City of Miami Beach
purchase the said easement at the consideration hereinabove stated
in, on and upon the following described lands, to wit:
The southerly fifteen (15) feet of
Lot Thirty-seven (37) , Block One (1) ,
NAUTILUS SUBDIVISION, according to the
Plat thereof, recorded in Plat Book 8,
page 95 of the Public Records of Dade
County, Florida;

and that the proper financial officers of the City of Miami
Beach be and they are hereby instructed to make disbursements
in accordance herewith.
