Resolution 9965 RESOLUTION NO. 9965
WHEREAS the State Road Department of Florida has
located and proposed to construct or reconstruct a part of
State Road 25, Section 8709-402; and
WHEREAS, in order for the State Road Department to
further and complete said project, it is necessary that
certain utilities and/or facilities within the Right of Way
limits of said State Road 25, Section 8709-402, be adjusted,
changed or relocated as follows, to wit:
Utilities on North Bay Road from Alton
Road back to Alton Road; also necessary
adjustments of utilities on Alton Road
with its intersection with the interstate
route North leg; also utilities at
intersection of West 41st Street and
Alton Road; also the intersection of
North Bay with Alton Road with the
intersection of the South leg of the
interstate route;
and
WHEREAS, the State Road Department having requested
the City of Miami Beach, Florida, to execute and deliver to
the State Road Department a Utilities Agreement entitled
"Agreement for Reimbursement for/Utility Work on Federal Aid
Projects", agreeing to make or cause to be made such adjustments,
changes or relocations of said utilities and/or facilities
as set out in said Agreement, and the City Council being
familiar with the terms and provisions thereof, and said
request having been duly considered; and
WHEREAS the City Council deems and finds it to the
best interests of the City to grant said request;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and the
City Clerk be and they are hereby authorized and directed to
make, execute and deliver to the State Road Department said
Agreement for the adjustment, change or relocation of said
utilities within the Right of Way limits of said State Road 25,
Section 8709-402;
BE IT FURTHER RESOLVED that there is hereby
appropriated from Unappropriated Surplus Funds of the City the
sum of $129, 112.50 for the performance of the terms and
provisions of said Agreement, subject to reimbursement to be
made to the City by the State Road Department in whole or in
part, as shall be determined to be in accordance with the terms
and provisions of said Agreement, and the disbursing officers
of the City are hereby authorized and directed to make proper
disbursements from the sum hereby appropriated, for the
purposes herein set forth.

BE IT FURTHER RESOLVED that a certified copy of
this Resolution be forwarded to the State Road Department
at Tallahassee, Florida.
