Resolution 10028 RESOLUTION NO. 10028
WHEREAS the City Council of the City of Miami Beach is considering
amending Ordinance No. 289, commonly known as the "Zoning Ordinance of
Miami Beach", and the maps attached thereto and made a part thereof so
as to create a "Height District" wherein the height of any building or
structure erected, constructed, or reconstructed shall be limited to a
specified maximum, to be determined by the City Council, and wherein such
maximum height or heights shall be permitted only upon fulfillment of such
conditions relating to ratios of height of building to front, rear and
side yard setbacks, or in accordance with such formulae relating to
permissible maximum building heights and minimum front, rear and side yard
setbacks, as shall be found necessary, and to place the following
described parcels cf land in such "Height District", to wit:
Lot A; Lots One (1) to Six (6), both inclusive, and Lots
Thirteen (13) to Twenty-three (23), both inclusive, all
in INDIAN BEACH CORPORATION SUBDIVISION, according to the
Plat thereof, recorded in Plat Book 8 at page 61 of the
Public Records of Dade County, Florida;
AND
Lots One (1) to Thirty 30), both inclusive, and Lot Two
Hundred Thirty-one (231), all in FIRST OCEAN FRONT SUB-
DIVISION, according to the Plat thereof, recorded in Plat
Book 78 of the Public Records of Dade County,
at page
Florida;
and
WHEREAS the City Council is also considering amending said ordinance
so as to provide for the regulation, restriction or limitation of the
nature and type of structural accessories or appurtenances that may be
erected, constructed or maintained on the structures or buildings erected,
constructed or reconstructed in said "Height District", and
WHEREAS the City Council is further considering amending said
ordinance so as to exclude said parcels of land from their present "Area
Districts " and to place the same in such other existing or to be created
"Area Districts " as shall be deemed necessary, and
WHEREAS said proposed Amendments are to be considered by the City
Council for the purpose of making adequate provision for light and air,
to prevent the overcrowding of land, to conserve the value of land and
buildings, and to encourage the use of said land for its most appropriate
use,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
MIAMI BEACH, FLORIDA, that a public hearing be and the same is hereby called
to be held on the 25th day of March, 1959, at 10:00 o 'clock a.m. , in the
Council Chambers, City Hall, Miami Beach, Florida, for consideration of
said amendments.
BE IT FURTHER RESOLVED that the City Clerk be and he is hereby directed
to give fifteen (15 ) days ' notice of the time, place and object of said
hearing by Public Notice thereof, published in the Miami Beach Sun, a
newspaper of general circulation in said City.
