Resolution 10084 efix47444' RESOLUTION NO. 10084 ki/vt/f7 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, CALLING AN ELECTION AT WHICH THERE SHALL BE SUBMITTED TO A VOTE THE MATTER OF ISSUANCE OF BONDS OF SAID CITY IN THE SUM OF 6,142,000.00 FOR THE PURPOSES IN THIS RESOLUTION STATED. WHEREAS, the City Council of the City of Miami Beach, Florida, deems it advisable to issue bonds of said City in amounts and for the municipal purposes set forth in the election notice provided for in Section 6 of the following resolution. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1. That, subject to the authorization of the duly registered and qualified voters of said City, who are freeholders therein, participating in the election according to law, which is hereinafter called, negotiable coupon bonds of the City of Miami Beach, Florida, shall be issued in the sums and for the purposes stated in the Notice of Election provided in Section 6 of this resolution, SECTION 2. That a special election is hereby called and directed to be held in the City of Miami Beach, Florida, from 7:00 o'clock A. M. until 7:00 o'clock P, M. on the 2nd day of June, A. D. 1959, for the purpose of submitting to a vote of the duly registered and qualified voters of said City who are freeholders therein the questions whether bonds of said City shall be issued in the sums and for the purposes stated in the Notice of Election provided for in Section 6 of this resolution. SECTION 30 That the City Clerk, who is also the Supervisor of Registration, open the books of said City from 9:00 o'clock A. M. until 5:00 o'clock P. M. each day, Sundays and Holidays excepted, from April 9th, 1959 to May 2, 1959, both inclusive, for the purpose of registering those electors who are qualified to register for this election, and after said May 2, 1959, no elector shall be registered for said election. SECTION 4. For the purpose of holding and conducting said election, the City of Miami Beach has been divided into voting precincts or election districts with polling places therein, as follows : PRECINCT NO. 25-A: Being the area within the City of Miami Beach lying between the North line of the corporate limits of the City of Miami Beach ON THE NORTH and a line ON THE SOUTH running westerly from the Atlantic Ocean along the center line of 71st Street to the center line of Indian Creek; thence northerly along the center line of Indian Creek to the center line of Normandy Waterway; thence westerly along the center line of Normandy Waterway to Biscayne Bay, the Polling Place of which shall be at the BISCAYNE ELEMENTARY SCHOOL situated on 77th Street between Tatum Waterway Drive and Dickens Avenue. PRECINCT NO. 25-B: Being the area within the City of Miami Beach lying between the South line of Precinct No. 25-A ON THE NORTH and the center line of 51st Street ON THE SOUTH, the Polling Place of which shall be at the 69TH STREET - 1 - FIRE STATION, situated at 6860 Indian Creek Drive. PRECINCT NO. 26: Being the area within the City of Miami Beach lying between the South line of Precinct No. 25-B ON THE NORTH and a line ON THE SOUTH running westerly from the Atlantic Ocean along the center line of 34th Street to Biscayne Waterway, thence westerly along the center line of Biscayne Waterway to Biscayne Bay, the Polling Place of which shall be at the NORTH BEACH ELEMENTARY SCHOOL, situated on the northeast corner of the intersection of Arthur Godfrey Road and Chase Avenue . PRECINCT NO. 27 : Being the area within the City of Miami Beach lying between the South line of Precinct No. 26 ON THE NORTH and a line ON THE SOUTH running westerly from the Atlantic Ocean along the center line of 23rd Street to Dade Boulevard, thence along the center line of Dade Boulevard to Biscayne Bay, also including Belle Isle, Rivo Alto Island, Di Lido Island and San Marino Island, the Polling Place of which shall be at the DADE BOULEVARD FIRE STATION, situated on the northwest corner of the intersection of Dade Boulevard and Pine Tree Drive. PRECINCT NO. 28: Being the area within the City of Miami Beach lying between the South line of Precinct No. 27 ON THE NORTH and a line ON THE SOUTH running westerly from the Atlantic Ocean along the center line of 15th Street to Bay Road, thence South along the center line of Bay Road to 14th Street, thence West along the center line of 14th Street to Biscayne Bay, the Polling Place of which shall be at the east entrance of the MUNICIPAL OFFICE BUILDING at 17th Street and Drexel Avenue. PRECINCT NO. 29: Being the area within the City of Miami Beach lying between the South line of Precinct No. 28 ON THE NORTH and a line ON THE SOUTH running westerly from the Atlantic Ocean to Biscayne Bay along the center line of 11th Street and said line produced, the Polling Place of which shall be at the FIRE STATION IN THE CITY RALL BUILDING, situated on 12th Street between Washington Avenue and Drexel Avenue. PRECINCT NO. 30: Being the area within the City of Miami Beach lying between the South line of Precinct No. 29 ON THE NORTH and a line ON THE SOUTH running westerly from the At- lantic Ocean along the center line of 7th Street to Alton Road, thence South along the center line of Alton Road to 6th Street, thence westerly along the center line of 6th Street to Biscayne Bay, the Polling Place of which shall be at the OCEAN FRONT AUDITORIUM, at 10th Street and Ocean Drive. PRECINCT NO. 31 : Being the area within the City of Miami Beach lying between the South line of Precinct No. 30 ON THE NORTH and a line ON THE SOUTH running westerly from the Atlantic Ocean along the center line of 3rd Street to Alton Road, thence along the South line of Lot 32 in Block 111 of Ocean Beach Addition No. 3 to Biscayne Bay, also including Star Island, Palm Island and Hibiscus Island, the Polling Place of which shall be at the SOUTH BEACH ELEMENTARY SCHOOL, situated between Third and Fourth Streets on Alton Road. PRECINCT NO. 32: Being all the area within the City of Miami Beach lying South of the South line of Precinct No. 31, - 2 - also including the Causeway property and the islands South of the County Causeway, the Polling Place of which shall be at the SOUTH SHORE PARK RECREATION CENTER BUILDING on Biscayne Street at Biscayne Bay. All being places where elections are usually held in said municipality. All electors shall vote at the Polling Places in the voting precincts in which the City Registration Books show that said electors reside. SECTION 5. That Thirty days' notice of said election shall be given by publication in the Miami Beach Sun, a newspaper published in the City of Miami Beach, Florida. Such publication shall be made at least once each week for four consecutive weeks during said period of thirty days. SECTION 6, That the Notice of Election shall be substantially in the following form: "CITY OF MIAMI BEACH, FLORIDA NOTICE OF SPECIAL ELECTION. NOTICE IS HEREBY GIVEN that an election has been called by the City Council of the City of Miami Beach, Florida, and will be held in said City from 7:00 o'clock A. M. until 7:00 o'clock P. M. on the 2nd day of June, A. D. 1959, at which there shall be submitted to the duly registered and qualified voters of said City who are freeholders therein the following questions : 1. Shall the City of Miami Beach, Florida, issue negotiable coupon bonds in the amount of $75,000.00 with interest at a rate to be hereafter determined, not exceeding 4% per annum, for the purpose of constructing storm sewers? 2. Shall the City of Miami Beach, Florida, issue negotiable coupon bonds in the amount of $160,000.00 with interest at a rate to be hereafter dett 4p d, not exceeding 4% per annum, for the purpose o SMI vements to the existing sanitary sewer system? 3. Shall the City of Miami Beach, Florida, issue negotiable coupon bonds in the amount of $150,000.00 with interest at a rate to be hereafter determined, not exceeding 4% per annum, for the purpose of lengthening the existing fishing pier at Biscayne Street in the Atlantic Ocean? 4. Shall the City of Miami Beach, Florida, issue negotiable coupon bonds in the amount of $200,000.00 with interest at a rate to be hereafter determined, not exceeding 4+% per annum, for the purpose of constructing a pier at Lincoln Road in the Atlantic Ocean? 5. Shall the City of Miami Beach, Florida, issue negotiable coupon bonds in the amount of $100,000.00 with interest at a rate to be hereafter determined, not exceeding 4% per annum, for the purpose of procuring a ladder truck and enlarging the 69th Street Fire Station? 6. Shall the City of Miami Beach, Florida, issue negotiable coupon bonds in the amount of $600,000.00 with interest at a rate to be hereafter determined, not exceeding 4% per annum, for the purpose of constructing a new building to house the Miami Beach Public Library? - 3 - 7. Shall the City of Miami Beach, Florida, issue negotiable coupon bonds in the amount of $1,100,000.00 with interest at a rate to be hereafter determined, not exceeding )44 per annum, for the purpose of paving that portion of Alton Road extending from Biscayne Waterway to 63rd Street and constructing a four lane bridge across Surprise Waterway at Alton Road? 8. Shall the City of Miami Beach, Florida, issue negotiable coupon bonds in the amount of $2,060,000.00 with interest at a rate to be hereafter determined, not exceeding 4% per annum, for the purpose of constructing a new water supply main from Miami to Miami Beach, including pumping stations, and the relocation of a portion of the MacArthur Causeway supply main and extensions to the water distribution system? 12. Shall the City of Miami Beach, Florida, issue negotiable coupon bonds in the amount of $525,000.00 with interest at a rate to be hereafter determined, not exceeding 4% per annum, for the purpose of constructing a public park on the ocean front extending from Collins Avenue to the Atlantic Ocean and located between 75th and 87th Streets? 13. Shall the City of Miami Beach, Florida, issue negotiable coupon bonds in the amount of $165,000.00 with interest at a rate to be hereafter determined, not exceeding 4% per annum, for the purpose of constructing a Community Center and Teen-Age Activities Building in that part of the City lying north of 63rd Street? 14. Shall the City of Miami Beach, Florida, issue negotiable coupon bonds in the amount of $400,000.00 with interest at a rate to be hereafter determined, not exceeding 4% per annum, for the purpose of constructing a bridge across Collins Canal and Dade Boulevard at Michigan Avenue? That there shall be apportioned and levied as special improvement assessments against the abutting property on a front foot basis such portion of the cost of the construction of the paving and sidewalks referred to in Question "8" hereinabove set forth as is by law authorized to be apportioned and levied. SECTION 9. That there shall be apportioned and levied as special improvement assessments made against the abutting property on a front foot basis such portion of the cost of construction of the paving and sidewalks referred to in Question "9" hereinabove set forth _ 11 _ as is by law authorized to be apportioned and levied. SECTION 10. That there shall be apportioned and levied as special improvement assessments against the abutting property on a front foot basis such portions of the cost of the construction of the highway improvements referred to in Question "10" hereinabove set forth as is by law authorized to be apportioned and levied, SECTION 11 . That the collections upon the special improvement assessments against abutting properties shall be deposited in the City's local improvement bond fund for application to interest and principal payments on the bonds hereby authorized and hereafter to be sold for the purpose of paying in the first instance the cost of said improvements. SECTION 12. That a special annual tax upon all taxable property within the City of Miami Beach, over and above all other taxes authorized or limited by law, or by the Charter of the City, sufficient to pay the interest and the principal of the bonds hereby authorized, t their several dates of maturity, shall be and is hereby levied rovided that the amount of such special annual tax levy shall be reduced by the amount then contained in the local improvement bond fund, and by the amount of special improvement assessments collected and then remaining in the local improvement bond fund, and by the amount of any other funds applicable to said bonds . SECTION 13. That the special improvement assessments against abutting property herein provided for, for highway and sidewalk improvements, are hereby pledged for the payment of principal and interest of the bonds hereby authorized for the purpose of such highway and sidewalk improvements and the proceeds of the special annual tax hereby provided for shall be used for nl other purpose than the payment of principal and interest of the bonds hereby authorized, at their several dates of maturity, and any balance collected at any time from such special annual tax after the payment of principal and interest upon the bonds hereby authorized shall be deposited in the local improvement bond fund. SECTION 14. That this resolution shall be effective immediately upon its passage and adoption as required by law. PASSED and ADOPTED this 8th day of April, A.
