Resolution 10123 RESOLUTION NO. 10123 PROVIDING FOR THE ELECTION OF A REGULAR EMPLOYEE OF THE CITY OF MIAMI BEACH AS AN EMPLOYEE MEMBER OF THE PERSONNEL BOARD REPRESENTING GROUP ONE WHEREAS, pursuant to the provisions of Section 4 of Chapter 18696, Laws of Florida, Acts of 1937, as amended in 1955, it is provided that there shall be three employees of regular status elected to the Personnel Board of the City of Miami Beach as Employee Members thereof, and WHEREAS, a vacancy has occurred in the office of the Employee Member of the Personnel Board representing Group 1 of employees of regular and probationary status, through the resignation of Sidney Unterberg, which resignation becomes effective upon the election of a new representative; and WHEREAS, it is therefore necessary that an election be called for the purpose of electing an Employee Member of the Personnel Board to represent Group 1 to fill the unexpired term of Sidney Unterberg, whose term expires at midnight, August 1, 1960. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Miami Beach, Florida, that a primary election and an election are hereby called for the purpose of electing an Employee Member of the Personnel Board for Group 1 to fill said unexpired term, said primary to be held between the hours of 7 :00 A.M. and 7 :00 P.M. on Tuesday, June 9, 1959, and said Election to be held between the hours of 7 :00 A.M. and 7 :00 P.M. on Tuesday, June 16, 1959, at the No. 2 Fire Station, Dade Boulevard. SECTION 1: That the City Clerk be and he is hereby instructed to notify the members of Group 1 of said primary election and election by posting notices stating the time, place and purpose of same , in a conspicuous place in each and every department of the city wherein members of Group 1 are employed. SECTION 2: That for the purpose of holding and conducting said primary and election, the City Clerk is hereby authorized to appoint three employees, one to serve as Clerk and the remaining two as Inspectors . SECTION 3: That the City Clerk be and he is hereby appointed as Super- visor of said primary and election, and is hereby further instructed to provide ballots and all necessary paraphernalia to the Clerk and Inspectors to enable them to properly hold and conduct said primary and election. SECTION 4 : That the two employees receiving the highest number of votes cast at the primary on June 9, 1959 in Group 1 shall be the only candidates for Board Member to be voted on at the election to be held on June 16, provided, however, that should any employee receive a majority of the votes cast at the primary, he shall be declared elected a member of the Personnel Board and the election in said Group 1, as herein planned, shall be omitted. SECTION 5 : That immediately after the polls are closed in the primary and in the election herein called, the Clerk and Inspectors shall proceed to open the ballot box and count the ballots cast, tabulating the result, and upon completion of said count they shall promptly certify, in duplicate, the result of said primary or election, as the case may be, to the City Clerk, on forms to be supplied them by the said City Clerk. SECTION 6: That the City Clerk be and he is hereby instructed to present to the City Council, at their first meeting following the holding of said election, the certificates of the said Clerk and Inspectors as to the result of said election, where- upon this Body shall canvass said certificates and declare the result .
