Resolution 10139 RESOLUTION NO. 10139
WHEREAS the Houston Gas and Oil Corporation requires
an easement for the construction, installation and maintenance
of a subterranean natural gas pipeline to supply the Peoples
Gas Company with natural gas at a vault to be located on the
north side of 11th Street, approximately 75 feet east of the
east line of Alton Road, and
WHEREAS the City Council of the City of Miami Beach
deems it to be for the best interests of the City and its
inhabitants that such easement be granted, and
WHEREAS the City Attorney has prepared an instrument
granting such easement, the terms and provisions of which are
familiar to the City Council,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and the City
Clerk be and they are hereby authorized to execute said
instrument for, in behalf of, and in the name of the City of
Miami Beach, which instrument shall provide for the grant of
an easement: "for the construction, installation and
maintenance of a subterrancean natural gas pipeline as follows:
Under and along 10th Street from the
bulkhead of Biscayne Bay to the East
property line of West Avenue, West
Avenue from the South property line of
loth Street to the north property line
of 11th Street, and 11th Street from
the west property line of West Avenue
to a point eighty (80) feet east of the
east property line of Alton Road. "
Provided, however, that the grant of said easement shall be only
for so long as said pipeline constitutes an integral and essential
component of any public utility system holding a franchise from
the City of Miami Beach and subject to all the covenants and
conditions of such franchise. Further provided that said easement
shall be limited to dedicated streets or public ways.
PASSED AND ADOPTED this 1st day of July, 1959.
