Resolution 10185 RESOLUTION NO. 10185 A RESOLUTION OF THE CITY COUNCIL: OF THE CITY OF MIAMI BEACH, FLORIDA, CABLING AN ELECTION AT WHICH THERE SHALL BE SUBMITTED TO A VOTE THE MATTER OF ISSUANCE OF BONDS OF SAID CITY IN THE SUM OF $600,000.00 FOR THE PURPOSE IN THIS RESOLUTION STATED. WHEREAS, the City Council of the City of Miami Beach, FloridF., deems it advisable to issue bQnds of said City in the amountand for the municipal purpose set forth in the election notice provided for in Section 6 of the following resolution. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL_ OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1. That, subject to the authorization of the duly registered and qualified voters of said City, who are freeholders therein, participating in the election according to law, which is hereinafter called, negotiable coupon bonds of the City of Miami Beach, Florida, shall be issued in the sum and for the purpose stated in the Notice of Election provided in Section 6 of this resolution. SECTION 2. That a special, election is hereby called and directed to be held in the City of Miami Beach, Florida from 7:00 o'clock A. M. until 7:00 o'clock P. M. on the 3rd day of November, A. D. 1959, for the purpose of submitting to a vote of the duly registered and qualified voters of said City who are free- holders therein the question whether bonds of said City shall be issued in the sum and for the purpose stated in the Notice of Election provided for in Section 6 of this resolution. SECTION 3. That the City Clerk, who is also the Supervisor of Registration, open the books of said City from 9:00 o'clock A. M. until 5:00 o'clock P. M. each day, Sundays and Holidays excepted, from September 17th, 1959 to October 10th, 1959, both inclusive, for the purpose of registering those electors who are qualified to register for this election, and after said October 10th, 1959, no elector shall be registered for said election. SECTION 4. For the purpose of holding and conducting said election, the City of Miami Beach has been divided into voting precincts or election districts with polling places therein, as follows : PRECINCT NO. 25-A: Being the area within the City of Miami Beach lying between the North line of the corporate limits of the City of Miami Beach ON THE NORTH and a line ON THE SOUTH running westerly from the Atlantic Ocean along the center line of 71st Street to the center line of Indian Creek; thence northerly along the center line of Indian Creek to the center line of Normandy Waterway; thence westerly along the center line of Normandy Waterway to Biscayne Bay, the Polling Place of which shall be at the BISCAYNE ELEMENTARY SCHOOL, situated on 77th Street between Tatum Waterway Drive and Dickens Avenue. - IL - PRECINCT NO. 25-B: Being the area within the City of Miami Beach lying between the South line of Precinct No. 25-A ON THE NORTH and the center line of 51st Street ON THE SOUTH, the Polling Place of which shall be at the 69TH STREET FIRE STATION, situated at 6860 Indian Creek Drive. PRECINCT NO. 26: Being the area within the City of Miami Beach lying between the South line of Precinct No. 25-B ON THE NORTH and a line ON THE SOUTH running westerly from the Atlantic Ocean along the center line of 34th Street to Biscayne Waterway, thence westerly along the center line of Biscayne Water- way to Biscayne Bay, the Polling Place of which shal 1 be at the NORTH BEACH ELEMENTARY SCHOOL, situated on the northeast corner of the intersection of Arthur Godfrey Road and Chase Avenue. PRECINCT NO. 27: Being the area within the City of Miami Beach lying between the South line of Precinct No. 26 ON THE NORTH and a line ON THE SOUTH running westerly from the Atlantic Ocean along the center line of 23rd Street to Dade Boulevard, thence along the center line of Dade Boulevard to Biscayne Bay, also including Belle Isle, Rivo Alto Island, Di Lido Island and San Marino Island, the Polling Place of which shall be at the DADE BOULEVARD FIRE STATION, situated on the northwest corner of the intersection of Dade Boulevard and Pine Tree Drive. PRECINCT NO. 28: Being the area within the City of Miami Beach lying between the South line of Precinct No. 27 ON THE NORTH and a line ON THE SOUTH running westerly from the Atlantic Ocean along the center line of 15th Street to Bay Road, thence South along the center line of Bay Road to 14th Street, thence West along the center line of 14th Street to Biscayne Bay, the Polling Place of which shall be at the east entrance of the MUNICIPAL OFFICE BUILDING at 17th Street and Drexel Avenue. PRECINCT NO. 29: Being the area within the City of Miami Beach lying between the South line of Precinct No. 28 ON THE NORTH and a line ON THE SOUTH running westerly from the Atlantic Ocean to Biscayne Bay along the center line of 111th Street and said line produced, the Polling P1 ace of which shall be at the FIRE STATION IN THE CITY HALL BUILDING, situated on 12th Street between Washington Avenue and Drexel Avenue. PRECINCT NO. 30: Being the area within the City of Miami Beach lying between the South line of Precinct No. 29 ON THE NORTH and a line ON THE SOUTH running westerly from the Atlantic Ocean along the center line of 7th Street to Alton Road, thence South along the center line of Alton Road to 6th Street, thence Westerly along the center line of 6th Street to Biscayne Bay, tYa Polling Place of which shall be at the OCEAN FRONT AUDITORIUM , at 10th Street and Ocean Drive. PRECINCT NO. 31 : Being the area within the City of Miami Beach lying between the South line of Precinct No. 30 ON THE NORTH and a line ON THE SOUTH running westerly from the Atlantic Ocean along the center line of 3rd Street to Alton Road, thence along the South line of Lot 32 in Block 111 of Ocean Beach,' Addition No. 3 to Biscayne Bay, also including Star Island, Palm Island and Hibiscus Island, the Polling Place of which shall be at the SOUTH BEACH ELEMENTARY SCHOOL, situated between Third and Fourth Streets on Alton Road. PRECINCT NO. 32: Being alli the area within the City of Miami Beach lying South of the South line of Precinct No. 31, also including the Causeway property and the islands South of the County Causeway, the Polling Place of which shall be at the SOUTH SHORE PARK RECREATION CENTER BUILDING on Biscayne Street at Biscayne Bay. - 2 - All being places where elections are usually held in said municipality. All electors shall vote at the Polling Places in the voting precincts in which the Citi; Registration Books show that said electors reside. SECTION 5. That Thirty days' notice of said election shall be given by publication in the Miami Beach Sun, a newspaper published in the City of Miami Beach, Florida. Such publication shall be made at least once each week for four consecutive weeks during said period of thirty days. SECTION 6. That the Notice of Election shall be substantially in the following form: "CITY OF MIAMI BEACH, FLORIDA NOTICE OF SPECIAL ELECTION NOTICE IS HEREBY GIVEN that an election has been called by the City Council of the City of Miami Beach, Florida, and will be held in said City from 7:00 o'clock A. M. until 7:00 o'clock P. M. on the 3rd day of November, 1959, at which there shall be submitted to the duly registered and qualified voters of said City who are freeholders therein the following question: Shall the City of Miami Beach, Florida, issue negotiable coupon bonds in the amount of $600,000.00, with interest at a rate to be hereafter determined, not exceeding 5 " per annum, for the payment of all or a part of which a special annual tax will be levied, the amount of which levy will be reduced by collections from special improve- ment assessments made against abutting property, as authorized by law, for the purpose of constructing a promenade, mall or walk on Lincoln Road from Washington Avenue to Alton Road? For the purpose of holding and conducting said election the City of Miami Beach has been divided into voting precincts or election districts with Polling Places therein as follows : PRECINCT NO. 25-A: Being the area within the City of Miami Beach lying between the North line of the corporate limits of the City of Miami Beach ON THE NORTH and a line ON THE SOUTH running westerly from the Atlantic Ocean along the center line of 71st Street to the center line of Indian Creek; thence northerly along the center line of Indian Creek to the center line of Normandy Waterway; thence westerly along the center line of Normandy Waterway to Biscayne Bay, the Polling Place of which shall be at the BISCAYNE ELEMENTARY SCHOOIL,,situated on 77th Street between Tatum Waterway Drive and Dickens Avenue. PRECINCT NO. 26: Being the area within the City of Miami Beach lying between the South line of Precinct No. 25-B ON THE NORTH and a line ON THE SOUTH running westerly from the Atlantic Ocean along the center line of 34th Street to Biscayne Waterway, thence westerly along the center line of Biscayne Waterway to Biscayne Bay, the Polling Place of which shall be at the NORTH BEACH ELEMENTARY SCHO13,, situated on the northeast corner of the intersection of Arthur Godfrey Road and Chase Avenue. PRECINCT NO. 27: Being the area within the City of Miami Beach - 3 - • lying between the South line of Precinct No. 26 ON THE NORTH and a line ON THE SOUTH running westerly from the Atlantic Ocean along the center line of 23rd Street to Dade Boulevard, thence along the center line of Dade Boulevard to Biscayne Bay, also including Belle Isle, Rivo Alto Island, Di Lido Island and San Marino Island, the Polling Place of which shall be at the DADE BOULEVARD FIRE STATION, situated on the northwest corner of the intersection of Dade Boulevard and Pine Tree Drive. PRECINCT NO. 28: Being the area within the City of Miami Beach lying between the South line of Precinct No. 27 ON THE NORTH and a line ON THE SOUTH running westerly from the Atlantic Ocean along the center line of 15th Street to Bay Road, thence South along the center line of Bay Road to 14th Street, thence West along the center line of 14th Street to Biscayne Bay, the Polling Place of which shall be at the east entrance of the MUNICIPAII OFFICE BUILDING at 117th Street and Drexel Avenue. PRECINCT NO. 29: Being the area within the City of Miami Beach lying between the South line of Precinct No. 28 ON THE NORTH and a line ON THE SOUTH running westerly from the Atlantic Ocean to Biscayne Bay along the center line of 11th Street and said line produced, the Polling Place of which shall be at the FIRE STATION in the CITY HALL BUILDING, situated on 12th Street between Washington Avenue and Drexel Avenue. PRECINCT NO. 30: Being the area within the City of Miami Beach lying between the South line of Precinct No. 29 ON THE NORTH and a line ON THE SOUTH running westerly from the Atlantic Ocean along the center line of 7th Street to Alton Road, thence South along the center line of Alton Road to 6th Street, thence westerly along the center line of 6th Street to Biscayne Bay, the Polling Place of which shall be at the OCEAN FRONT AUDITORIUM at 10th Street and Ocean Drive. PRECINCT NO. 31 : Being the area within the City of Miami Beach lying between the South line of Precinct No. 30 ON THE NORTH and a line ON THE SOUTH running westerly from the Atlantic Ocean along the center line of 3rd Street to Alton Road, thence along the South line of L,ot 32 in Block 111 of Ocean Beach Addition No. 3 to Biscayne Bay, also including Star Island, Palm Island and Hibiscus Island, the Polling Place of which shall be at the SOUTH BEACH ELEMENTARY SCHOOL, situated between Third and Fourth Streets on Alton Road. PRECINCT NO. 32: Being the area within the City of Miami Beach lying South of the South line of Precinct No. 31, also including the Causeway property and the islands South of the County Causeway, the Polling Place of which shall be at the SOUTH SHORE PARK RECREATION CENTER BUILDING on Biscayne Street at Biscayne Bay. All being places where elections are usually held in said muni- pality. Al 1 electors shall vote at the Polling Places in the voting precincts in which the City Registration Books show that said electors reside. The voting shall not be on voting machines, but shall be on separate paper ballots - 4 - The Registration Books will be open from Nine o'clock A. M. until Five o'clock P. M. each day, Sundays and T-Tolidays excepted, from September 17th, 1959 to October 10th, 1959, both inclusive, for the registration of persons qualified to register for said election. That the voting shall not be on voting machines, but shall be on separate paper ballots; the form of ballot to be used in said election shall be in substantially the following form: "OFFICIAL BALLOT CITY OF MIAMI BEACH, FLORIDA SPECIAL ELECTION NOVEMBER 3RD,1959 Shall the City of Miami Beach, Florida, issue negotiable coupon bonds in the amount of $600,000.00 with interest at a rate to be hereafter determined, not exceeding 5% per annum, for the payment of all or a part of which a special annual tax will be levied, the amount of • which levy will be reduced by collections from special improvement assessments made against abutting property, as authorized by law, for the purpose of constructing a promenade, mall or walk on Lincoln Road from Washington Avenue to Alton Road? • FOR BONDS • • AGAINST BONDS MAKE A CROSS (X) BEFORE YOUR CHOICE" SECTION 8. That there shall be apportioned and levied as special improvement assessments against the abutting property on a front foot basis such portion of the cost of the construction of the promenade, walk or mall referred to in the question hereinbefore set forth as is by law authorized to be apportioned. SECTION 9. That the collections upon the special improvement assessments against abutting properties shall be deposited in the City's local improvement bond fund for application to interest and principal payments on the bonds hereby authorized and hereafter to be sold for the purpose of paying in the first instance the cost of said improvements. - 5 - SECTION 10. That a special annual tax upon all taxable property within the City of Miami Beach, over and above all other taxes authorized or limited by law, or by the Charter of the City, sufficient to pay the interest and the principal of the bonds hereby authorized, at their several dates of maturity, shall be and is hereby levied, provided that the amount of such special annual tax levy shall be reduced by the amount then contained in the local improvement bond fund, and by the amount of special improvement assessments collected and then remaining in the local improvement bond fund, and by the amount of any other funds applicable to said bonds. SECTION 11. That the special improvement assessments against abutting property herein provided for are hereby pledged for the payment of principal and interest of the bonds hereby authorized and the proceeds of the special annual tax hereby provided for shall be used for no other purpose than the payment of principal and interest of the bonds hereby authorized, at their several dates of maturity, and any bnlanee collected at any time from such special annual tax after the payment of principal and interest upon the bonds hereby authorized shall be deposited in the local improvement bond fund. SECTION 12. That this resolution shall be effective immediately upon its passage and adoption as required by law. PASSED and ADOPTED this 16th day of September, A, D. 1959.
