RESOLUTION NO. 10189
WHEREAS the City Council of the City of Miami Beach,
Florida, did heretofore require, as a condition precedent to
the approval of the plat of Bay Lincoln Subdivision, Plat Book 58
at page 86 of the Public Records of Dade County, Florida, the
posting of a surety bond for the construction of a certain
street, sidewalks, sanitary sewers, storm sewers and other
necessary drainage facilities in said subdivision, and
WHEREAS said condition precedent has been duly
fulfilled by the posting of such surety bond, and
WHEREAS the obligor of said bond has duly performed
all of the conditions set forth in said condition precedent,
with the exception of the construction of sidewalks, and
WHEREAS the obligor has duly submitted to the City
of Miami Beach a petition signed by the owners of thirteen of
the fifteen lots in said subdivision reciting and setting forth
that the said owners are "satisfied with the improvements that
have been installed and do hereby deem it unnecessary that
sidewalks be installed, particularly for the reason that the
property in said subdivision is used for off-street parking
by the tenants occupying the various properties" and has
represented to the City Council that the signatures of the
remaining two owners of the properties in said subdivision do
not appear on said petition because of their absence from the
City, and
WHEREAS said petitioners have requested the City of
Miami Beach to permit said subdivision bond to be cancelled
and that the principal and surety be discharged of all liability
thereunder, and
WHEREAS the City Engineer has recommended approval
of the said petition, and
WHEREAS the City Council deems it to be to the best
interests of the said City and the inhabitants thereof to
grant said petition,
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COUNCIL
OF THE CITY OF MIAMI BEACH, FLORIDA, that the said surety bond
executed by Irving Nathanson, as Trustee, as principal, and
All-Florida Surety Company, as surety, on the 18th day of June,
1954, be and they are hereby relieved and discharged of all
liability under said bond, and that such release and discharge
be effective as of the 18th day of June, 1959.
