RESOLUTION NO. 10230
WHEREAS, on the 4th day of June, 1958 the City Council
of the City of Miami Beach authorized the execution of a lease
between the City of Miami Beach as lessee, and Fred Abrams and
Herbert Abrams as lessors, whereby the City leased those certain
premises commonly known as 707 - 71st Street, Miami Beach, Florida,
for use as a branch public library for a term of three years
commencing June 1, 1958, with an option for a renewal thereof
for an additional term of two years, and
WHEREAS said lease provided for a monthly rental of
$165.00 per month and an annual rental of $1, 920 .00, thereby
creating an ambiguity as to the amount of the agreed rental, and
WHEREAS it is necessary that the said ambiguity be
eliminated, and
WHEREAS the City Attorney has prepared an amendment to
said lease whereby said ambiguity is eliminated,
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COUNCIL
OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and the
City Clerk be and they are hereby authorized and directed to
execute said amendment to the said lease in the name of and on
behalf of the said City so as to provide that the monthly rental
for the said premises for the term of three years shall be $165.00
per month, and that the annual rental shall be $1,980 .00; and
the disbursing officers of the City are hereby authorized and
directed to make the expenditure required in accordance with the
terms of said lease, as amended, out of the funds of the City
available for such purpose.
