Resolution 2018-30485RESOLUTION NO. 2018 -30485 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, URGING THE FLORIDA LEGISLATURE TO STUDY AND ADOPT LEGISLATION TO ADDRESS AND REGULATE THE NUMBER OF TRANSPORTATION NETWORK COMPANY VEHICLES. WHEREAS, in recent years, for -hire app -based ride services, such as Uber and Lyft, have experienced exponential growth locally and across the nation; and WHEREAS, the unchecked rapid expansion of such transportation services has led to issues of traffic congestion and negative impacts on the livelihoods of traditional taxi and limousine service drivers who are losing work and finding it increasingly difficult to make a living; and WHEREAS, in addition, concerns relative to the lack of minimum wage standards for Uber and Lyft drivers has garnered public attention and, in New York City, legislation was recently adopted which imposes not only a 12 -month cap on new for -hire vehicle licenses, excluding those for wheel- chair accessible vehicles, but requires that a study be conducted to analyze the new app -based industry's impact on the city relative to traffic and minimum fare standards; and WHEREAS, the Florida Legislature recently adopted regulations in Section 627.748 of the Florida Statutes that, except in limited areas relating to airport and seaport pickup fees and the designation of staging, pickup, and other such operations, preempt local governments from regulating these transportation network companies; and WHEREAS, the City of Miami Beach and Miami -Dade County have also experienced the effects of this new and rapidly growing industry on traffic congestion. Therefore, the Florida Legislature should study and evaluate the traffic impacts that have resulted in our communities from these transportation services so that appropriate regulations to address the proliferation of these vehicles can be developed and adopted. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby urge the Florida Legislature to study and adopt legislation to address and regulate the number of transportation network company vehicles.
