Resolution 10359 RESOLUTION NO. 10359
WHEREAS the City of Miami Beach deems it to be
to the best interest of said City to acquire for street and
sidewalk purposes the following described land situate in
the City of Miami Beach, Dade County, Florida, to wit:
A tract of land bounded on the north by
the northerly line of that Deed of
Dedication from the Florida Power and
Light Company to the City of Miami Beach,
recorded in Deed Book 2445, at page 201
of the Public Records of Dade County,
Florida, produced westerly; bounded on
the southerly side by the southerly line
of the above mentioned Deed of Dedication
produced westerly; bounded on the easterly
side by the westerly line of the above
mentioned Deed of Dedication; bounded on
the westerly side by a line parallel to
and seven and one-half (72) feet westerly
of the above mentioned easterly boundary;
and
The easterly two and one-half (22) feet
of Lots 8 and 9, Block 3, BEACH BAY
SUBDIVISION, according to the Plat thereof
recorded in Plat Book 44 at page 25 of the
Public Records of Dade County, Florida, said
two and one-half (22) feet to be measured at
right angles to the westerly line of Harding
Avenue as shown on the above mentioned Plat;
and
WHEREAS the respective owners of said lands have
indicated their willingness to convey the said lands to the
City in consideration of the benefits that would accrue to
such owners and in consideration of the City ' s bearing the
entire cost of the street and sidewalk to be constructed on
said lands and the paving, curb and gutter and lighting on
that portion of the public street upon which the said lands
of said owners abut, and
WHEREAS the City Attorney has prepared proposed
agreements between the City and the said owners,

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and the
City Clerk be and they are hereby authorized and directed to
execute, in the name of and on behalf of said City, the said
agreements with each of the said owners .
