Resolution 10361 RESOLUTION NO. 10361
WHEREAS, by Resolution No. 10343 adopted June 15,
1960, the City Council of the City of Miami Beach authorized
and directed the execution and delivery of an agreement by
and between the City and the Greater Miami Hebrew Academy, a
Florida non-profit corporation, for the sale of certain land
described in said Resolution upon the terms and conditions
therein set forth, and
WHEREAS said agreement has not been executed by
the Greater Miami Hebrew Academy for the reason that the
provision for reversionary right in the City to re-acquire
the fee simple title to the land to be conveyed by the City
in the event the said land is no longer used for school
purposes prevents the Greater Miami Hebrew Academy from
obtaining an appropriate mortgage loan for the construction
of the school to be erected on said land, and
WHEREAS modification of said agreement may be made
in such manner so as to permit the Greater Miami Hebrew Academy
to obtain an appropriate mortgage loan without impairing the
substantial rights of the City or its inhabitants, and
WHEREAS the City Council of the City of Miami Beach
deems it to be to the best interests of the City and its
inhabitants that a new agreement be entered into in lieu of
the agreement heretofore authorized, and
WHEREAS the City Attorney has prepared such new
agreement, the terms of which are familiar to the City Counci'
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF MIAMI BEACH, that the Mayor and the City Clerk
be and they are hereby authorized and directed to execute and
deliver said new agreement for and in lieu of the agreement
previously authorized by Resolution No. 10343 .
