Resolution 10427 RESOLUTION NOV, 10427 WHEREAS , Florida Power & Light Company is the owner of that certain parcel of land situate in the City of Miami Beach, Florida, described as follows , to wit : A parcel of land lying in Government Lot 1 of fractional Section 2, Township 53 South, Range 42 East , in the City of Miami Beach, Dade County, Florida, more particularly described as follows : Starting at the point of intersection of the South line of Nasturtium Street (87 Terrace) and the West line of the twenty (20' ) foot alley , as said lines are shown upon the plat of Altos Del Mar Subdivision No. 2, recorded in Plat Book 4, page 162 of the public records of Dade County, Florida, run westerly along the said south line of Nasturtium Street (87 Terrace) a distance of 142. 5 feet; thence Southerly, at a ninety degree angle, 91 feet to a point; thence easterly , at a ninety degree angle 144. 8 feet to the West line of the aforementioned twenty (20' ) foot alley; thence run Northerly , along the West line of the said twenty (20' ) foot alley, a distance of 91. 03 feet to the point of Beginning, less street as dedicated; and WHEREAS , it is the desire of the City of Miami Beach that a sidewalk be constructed by said Florida Power & Light Company for the use of the public on the easterly portion of said land and; WHEREAS , the Florida Power & Light Company is willing to construct, at its own expense, a sidewalk on the westerly five (5) feet of the easterly seven and one-half (7-1/2' ) feet of the above described parcel of land, but only if assurance is given by the City of Miami Beach that the existing building set-back requirements will remain unchanged; and WHEREAS , the members of the City Council of the City of Miami Beach are willing to grant such assurance in order to obtain con- struction of such sidewalk; NOW, THEREFORE , BE IT RESOLVED by the City Council of the City of Miami Beach, Florida, that if the Florida Power & Light Company constructs , at its own expense , a sidewalk on the westerly five (5) feet of the easterly seven and one-half (7-1/2' ) feet of said property , then and in that event the said City Council, insofar as it may legally bind said City so to do , agrees that there will be no change in the future in the set-back requirements as to said land from those which now exist under the terms of the Zoning Ordinance of said City.
