Resolution 10450 1000 � " 9v ^ RESOLUTION NO. 10450 ",ct U WHEREAS, by that certain instrument recorded in Deed Book 2075 at page 191 of the Public Records of Dade County, Florida, there was dedicated to the City of Miami Beach for use by the City and by the public as a street or alleyway, that certain land described as follows : A certain rectangular strip of land Twenty (20) feet in width, and bounded on the North by the South line of Lot Four (4) , of Block Fifty-three (53) , of PINE RIDGE, a subdivision of Dade County, Florida, according to the Plat thereof recorded in Plat Book 6 at page 34 of the Public Records of Dade County, Florida; on the East by Washington Avenue; on the West by Drexel Avenue; and on the South by a line parallel to and Twenty (20) feet distant from the said South line of said Lot Four (4) of Block Fifty-three (53) , of PINE RIDGE, as aforesaid; and WHEREAS the owners in fee thereof, and of the land abutting thereon, have requested the City of Miami Beach to vacate, abandon, and surrender the easterly 102.38 feet of said street or alleyway, and have offered to dedicate by written instrument to the City of Miami Beach, its successors and assigns, for street or alleyway purposes or use, the following described land, to wit: Beginning at the southeast corner of Lot 10, or the southwest corner of Lot 1, Block 53, PINE RIDGE SUBDIVISION, as recorded in Plat Book 6 at page 34 of the Public Records of Dade County, Florida; run easterly along the southerly line of said Lot 1, Block 53, a distance of 5 .0 feet to a point; thence run northwesterly along a line deflecting 135° to the left, a distance of 7 .07 feet to a point; thence run northerly along a line parallel to and 1.07 feet distant easterly from the westerly line of Lots 1 and 2 of said Block 53, a distance of 98.0 feet to a point; thence run northeasterly along a line deflecting to the right 10 °29 ° 25 . 2" a distance of 21 .58 feet to a point; thence run Westerly along a line deflecting 90 ° to the left along the southerly line of said described alley, said line being parallel to and 20 .0 feet distant southerly from the northerly line of Lots 3 and 5 of said Block 53, a distance of 34. 28 feet to a point; thence run southerly along a line deflecting 90 ° to the left a distance of 24.65 feet to a point; thence run easterly along a line deflecting 90 ° to the left, a distance of 24.38 feet to a point; thence run southerly along a line parallel to and 5 .0 feet distant westerly from the easterly line of Lots 5, 6, 7 and 8 of said Block 53, a distance of 121 .12 feet to the Point of Curvature (P.C.) of a circular curve; thence run southwesterly along the arc of a circular curve deflecting to the right having for its elements a central angle of 18° 11 ' 41 .5 ", a radius of 50 .0 feet, a distance of 15 .88 feet, to the Point of Reverse Curvature, (P.R.C. ) of said circular curve; thence run southwesterly along the arc of a circular curve deflecting to the left, having for its elements a central angle of 18° 11 ' 41.5", a radius of 50 .0 feet, a distance of 15 .88 feet to the Point of Tangency (P.T. ) of said curve; thence run southerly tangent to the last mentioned circular curve along a line parallel to and 10 .0 feet distant westerly from the easterly line of Lots 8, 9 and 10 of said Block 53, a distance of 98.0 feet to a point; thence run southwesterly along a line deflecting 45 ° to the right, a distance of 7 .07 feet to a point on the southerly line of said Lot 10, Block 53; thence run easterly along a line deflecting 135 ° to the left along the southerly line of Lot 10 of said Block 53, or the northerly line of 16th Street, a distance of 15 .0 feet to the point of Beginning of the parcel of land herein described, containing 0 .058 acres, more or less; subject to the right of said owners to maintain existing overhead structures and to construct and maintain a building column in an area twenty (20) inches square in the northeasterly corner of the latter described land, all as is more fully set out in said written instrument, the terms and provisions of which are familiar to the City Council of the City of Miami Beach, and WHEREAS the City Council of the City of Miami Beach deems it to the best interests of the City of Miami Beach and the public to vacate, abandon and surrender the use of the easterly 102.38 feet of the land first described herein, and to accept the -2- OFFICE OF CITY ATTORNEY - CITY HALL - MIAMI BEACH 39, FLORIDA offer of dedication of the land latterly described herein for street or alleyway use, provided, however, that as a condition of the vacating, abandonment and surrender of said easterly 102.38 feet, the owners and dedicators of the latterly described land shall at their own cost and expense: 1 . remove an existing building column thereon; A ` 2. suitably pave and surface the same; and 4"' if ,t � ap ' 3 . remove any existing public utility installations �YY (v.a • tk in, on or under said easterly 102 .38 feet, NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH that the City of Miami Beach for itself, its successors and assigns, and the public generally, does hereby vacate, abandon, surrender, and does hereby free of said dedication the following described land, to wit: the easterly 102.38 feet of a certain rectangular strip of land twenty (20) feet in width, and bounded on the North by the South line of Lot 4, of Block 53 , of PINE RIDGE, a Subdivision of Dade County*. Florida, according to the Plat thereof, recorded in Plat Book 6 at page 34 of the Public Records of Dade County, Florida; on the East by Washington Avenue; on the West by Drexel Avenue; and on the South by a line parallel to and twenty (20) feet distant from the said South line of said Lot 4 of Block 53, of PINE RIDGE, as aforesaid; provided, however, that said vacating, abandoning, and surrendering of said easterly 102.38 feet shall become effective only upon the City Engineer filing with the City Clerk his certificate that the said owners and dedicators have performed each of the conditions hereinabove set forth, and BE IT FURTHER RESOLVED that the City of Miami Beach, for itself, its successors and assigns, and for the public generally, accepts the dedication of the land described in said instrument of dedication. Johnson, City Clerk Pursuant to the provisions of Resolution No. 10450 and Resolution No. 10492 I hereby certify that each of the conditions enumerated and set forth therein upon which the vacating and abandoning of that certain portion of the street or alleyway described as follows, to wit: the easterly 102.38 feet of a certain rectangular strip of land twenty (20) feet in width, and bounded on the North by the South line of Lot 4, Block 53, of PINE RIDGE, a subdivision of Dade County, Florida, according to the Plat thereof, recorded in Plat Book 6 at page 34 of the Public Records of Dade County, Florida; on the East by Washington Avenue; on the West by Drexel Avenue; and on the South by a line parallel to and twenty (20) feet distant from the said South line of said Lot 4 of Block 53, of PINE RIDGE, as aforesaid; shall become effective, have been fully performed.
