WHEREAS, pursuant to the provisions of Section 11,
Ordinance No. 1140, of the City of Miami Beach, granting a
Franchise to the Miami Beach Railway Company, the said Miami
Beach Railway Company has heretofore delivered ten (10)
One Thousand Dollar ($1,000 .00) United States Government
Bonds, described as follows:
364185E with 34 coupons attached
302920L with 34 coupons attached
288463C with 34 coupons attached
282713C with 34 coupons attached
282711A with 34 coupons attached
144710L with 34 coupons attached
114108J with 34 coupons attached
18468 J with 34 coupons attached
18469 K with 34 coupons attached
290453C with 34 coupons attached
as security for the self-insurer provisions of said Ordinance,
said Bonds being held for safe-keeping by the Miami Beach
First National Bank, as authorized by Resolution No. 3163, and
WHEREAS said Miami Beach Railway Company has requested
the City for the return of said Bonds, and for leave to substitute
therefor an approved surety bond in the sum of Twenty Thousand
Dollars ($20,000 .00) conditioned as required by said Ordinance, and
WHEREAS said surety bond has been duly approved by the
City Attorney as meeting the requirements of said ordinance,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF MIAMI BEACH that said surety bond be accepted in
lieu of said United States Government Bonds and that the Miami
Beach First National Bank be and it is hereby authorized and
directed to deliver and surrender said United States Government
Bonds, hereinabove described, to the Miami Beach Railway Company,
and
BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE
CITY OF MIAMI BEACH that the City Clerk be and he is hereby
authorized and directed to transmit a duly certified copy of
this Resolution to the Miami Beach First National Bank as
sufficient proof and authority for said Bank to surrender and
deliver said Bonds to said Miami Beach Railway Company.
PASSED AND ADOPTED this 1st day of February, 1961.
