A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, AMENDING CITY OF MIAMI
BEACH RESOLUTION NO. 2003-25124 CREATING THE MIAMI BEACH
AD HOC CHARTER REVIEW AND REVISION BOARD SO AS TO
ENLARGE ITS POWERS OF REVIEW TO INCLUDE THE CITY'S
RELATED SPECIAL ACTS PORTION OF THE CITY CODE.
WHEREAS, the Mayor and City Commission of the City of Miami Beach, Florida, via its
Resolution No. 2003-25124, created the City of Miami Beach Ad Hoc Charter Review and Revision
Board under authority of Section 8.01 of the Miami Beach City Charter mandating that the Charter
"...shall be reviewed ten years from November 3~d, 1993 and each tenth year thereafter"; and
WHEREAS, City of Miami Beach Resolution No. 2003-25124 stated the Board powers of
review to include "submittal of a report to the City Commission by June 1 st, 2003, which report shall
include any recommendations concerning proposed amendments to the City's Charter"; and
WHEREAS, on March 19th, 2003, the City Commission referred to the Charter Review
Board the issue of reviewing Section 2 of the Special Related Acts portion of the City Code
regarding the Zoning Board of Adjustment, for possible amendments thereto; and
WHEREAS, inasmuch as the enabling legislation for the Charter Review Board limited the
Board's power to review of the City Charter, said Resohition No. 2003-25124 requires amendment to
expand its powers of review to include the City's Related Special Acts portion of the City Code.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that it hereby amends City of
Miami Beach Resolution No. 2003-25124 so as to enlarge the powers of the Miami Beach Ad Hoc
Charter Review and Revision Board to include review of the City's Related Special Acts portion of
the City Code, as well as the City Charter.

REVIEW AND REVISION BOARD RECOGNIZING THE MIAMI BEACH
CITY COMMISSION'S DIRECTIVE TO REVIEW SECTION 2 OF THE
SPECIAL RELATED ACTS PORTION OF THE CITY CODE
CONCERNING CITY OF MIAMI BEACH ZONING BOARD OF
ADJUSTMENT, AND THUS PROPOSING AN AMENDMENT TO CITY OF
MIAMI BEACH RESOLUTION NO. 2003-25124 CREATING THE
CHARTER REVIEW BOARD SO AS TO ENLARGE ITS POWERS OF
REVIEW TO INCLUDE THE CITY'S RELATED SPECIAL ACTS PORTION
OF THE CITY CODE.

thus be expanded to include review of the City's Related Special Acts.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY OF THE BEACH
AD HOC CHARTER REVIEW AND REVISION BOARD, that pursuant to the request of the
City Commission to review a portion of the Special Related Acts of the City Code, it hereby requests
and encourages amendment of City of Miami Beach Resolution No. 2003-25124 so as to enlarge its
powers of review to include Board review of the City's Related Special Acts portion of the City
Code, as well as the City Charter.

Amending City of Miami Beach ResolUtion No. 2003-25124 creating City of
Miami Beach Ad Hoc Charter Review and Revision Board--enlarging
Powers of Board.
On March 19th, 2003, the Miami Beach City Commission referred to the City's Charter
Review Board the issue of reviewing proposed amendments to Section 2 of the City's Special
Related Acts portion of the City Code, relating to the City of Miami Beach Zoning Board of
Adjustment. Inasmuch as the Charter Review Board's enabling legislation (City of Miami Beach
Resolution No. 2003-25124) limits its powers of review to the City Charter, the subject
Resolution needs to be amended to authorize expansion of Board powers to include review of the
Special Related Acts; attached is thc Charter Review Board resolution reflecting the above, as
well as the proposed City of Miami Beach Resolution.
