Resolution 10542 RESOLUTION NO. 10542
WHEREAS, the City Council of the City of Miami Beach deems
it to be necessary to acquire, for off the street parking of
automobiles, the fee simple title in and to that certain parcel of
land situate in the City of Miami Beach, Dade County, Florida,
comprising a southerly portion of Lots 40, 41, 42, 43 and 44,
in Block 10, of OCEANSIDE SECTION of ISLE OF NORMANDY, according
to the plat thereof, recorded in Plat Book 25, page 60 of the
public records of Dade County, Florida, a description of which is
fully set forth in the agreement between the owners of said land
and the City, hereinafter referred to; and
WHEREAS, GEORGE P. JACOBS and wife and MIKE ACKERMAN and
wife, the said owners, have agreed to sell and convey said land
to the City of Miami Beach for the sum of $75,625.00, payable as
follows : Cash in the sum of $22,687.50 and a purchase money
mortgage for the balance of the purchase price secuuring two
notes, each in the sum of $26,468.75, one of the notes payable
one year after date of closing of the transaction and the other
note payable two years after date of closing, said notes to bear in-
terest at the rate of 422 per annum payable semi-annually; and
WHEREAS, there has been prepared and submitted to the
City Council an agreement between the owners and the City, whereby
the said owners agree to sell and the City agrees to purchase said
land upon the terms and conditions set forth in said agreement,
the City Council being familiar with the contents thereof; and
WHEREAS, the City Council deems it to be to the best
interest of the City of Miami Beach and its inhabitants to purchase
said land for the purpose of off the street parking of automobiles
at the price and upon the terms and conditions set forth in said
agreement;
NOW, THEREFORE, BE IT RESOLVED by the CITY COUNCIL OF THE
CITY OF MIAMI BEACH, FLORIDA, that the Mayor and the City Clerk
be and they are hereby authorized and directed to execute said
agreement in the name of and on behalf of said City.
BE IT FURTHER RESOLVED that the disbursing officers of
said City be and they are hereby authorized and directed to make
the expenditures called for by said agreement from funds
of the
City available for such purpose, and that the proper officers of
said City be and they are hereby authorized to execute the
necessary instruments to carry out the terms of said agreement.
