RESOLUTION 10574
WHEREAS, a certain building has heretofore been erected
upon that certain parcel of land situate in the City of Miami Beach,
Florida, described as follows:
Lots 39 thru 42 inclusive - Amended Plat of Belle Isle
According to a Plat thereof as recorded in Plat Book 5,
Page 11, Public Records of Dade County.
AND WHEREAS, a recent survey made by Zurwelle-Whit-
taker, Inc. reveals that the concrete canopy encroaches upon
Island Avenue 16 " for a distance of 25!, said avenue being a
public street of the City of Miami Beach, Florida, copy of said
survey being hereto attached, and
WHEREAS, it is the opinion of the City Council that the
said encroachment was unintentional,
NOW, THEREFORE, BE IT RESOLVED by THE CITY COUNCIL
OF THE CITY OF MIAMI BEACH, FLORIDA,
That, insofar as said Council has the power to bind the City
of Miami Beach in the premises, no action of any kind whatsoever
shall be taken by the said City to require the owners of the said
property or their heirs, successors or assigns to move, or remove,
the portion of structures encroaching upon said public street as
aforesaid.
PASSED and ADOPTED this 21st day of June , 1961.
