Resolution 10580 RESOLUTION NO. 10580
WHEREAS, certain improvements have been heretofore
constructed upon that certain parcel of land situate in the City
of Miami Beach, Florida, described as follows:
Lots 10 and 11, Block 4, Orchard Subdivision
No. 4, according to a Plat thereof as recorded
in Plat Book 25, Page 30, Public Records of
Dade County, Florida
AND WHEREAS, a survey made by Biscayne Engineering Co.
on December 23 , 1960 reveals that said improvements encroach upon
Arthur Godfrey Road, the same being a public street of the City
of Miami Beach, Florida, copy of said survey being hereto attached,
and
WHEREAS, it is the opinion of the City Council of the
City of Miami Beach, Florida that the said encroachment is neg-
ligible and unintentional, and does not interfere with the use by
the public of said public street, and
WHEREAS, the owners of said real estate, and other parties
in interest therein, have requested the City Council to waive
objection to said encroachments, and
WHEREAS, the City Council of the City of Miami Beach
deems it to be in the best interests of the City, its residents,
and taxpayers, to grant such waiver,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF MIAMI BEACH, FLORIDA,
That, insofar as said Council has the power to bind the
City of Miami Beach in the premises, no action of any kind whatsoever
shall be taken by the said City to require the owners of the said
property or their heirs, successors or assigns to move, or remove,
the portion of structures encroaching upon said public street as
aforesaid.
PASSED AND ADOPTED this 28th day of June, 1961.
