RESOLUTION NO. 10598
RESOLUTION LOCATING AND FIXING BULKHEAD LINE
SUBJECT TO APPROVAL OF TRUSTEES OF THE INTERNAL
IMPROVEMENT FUND OF THE STATE OF FLORIDA
WHEREAS, a public hearing upon the location and
fixing of a bulkhead line in Indian Creek was held by the City
Council of the City of Miami Beach, Florida on July 21, 1961,
after notice as required by Section 253.122 Florida Statutes; and
WHEREAS, said City Council finds and determines that
it is to the best interest of the public that such bulkhead line
be located and fixed;
NOW, THEREFORE, BE IT RESOLVED by the CITY COUNCIL
OF THE CITY OF MIAMI BEACH, FLORIDA that, subject to the approval
of the Trustees of the Internal Improvement Fund of the State of
Florida, the bulkhead line, as shown upon the attached sketch
and drawing, entitled "Proposed Bulkhead Line Easterly Side of
Indian Creek opposite Lots 1 through 231, First Ocean Front
Subdivision, prepared by Morris N. Lipp, City Engineer" and
dated the 7th day of July, 1961, be and the same is hereby
determined, located and fixed under the authority vested in this
Cite Council by Section 253.122, Florida Statutes, and the
Trustees of the Internal Improvement Fund of the State of Florida
are hereby requested to give their approval to such bulkhead
line.

CERTIFICATE OF APPROVAL
FOR ESTABLISHMENT OF BULKHEAD LINE
No . 13 (1-29-63)
WHEREAS , Chapter 57-362, Laws of Florida, Acts of 1957,
Florida Statutes 253.122, authorizes local authorities to
locate and fix bulkhead lines in the tidal waters within
their jurisdictional limits for the purpose of controlling
dredging and filling of submerged sovereign lands in the
interest of the public; and
WHEREAS, the Trustees of the Internal Improvement Fund
of the State of Florida, in whose custody the sovereign lands
and waters are vested for the protection of the public interest,
are responsible for reviewing and approving bulkhead lines
established locally; and
WHEREAS, THE CITY COUNCIL OF THE CITY OF MIAMI REACH,
DADE COUNTY, FLORIDA, by Resolution No . 10598 passed on the
21st day of July, 1961, did adopt and submit to the Trustees
of the Internal Improvement Fund for, formal approval a bulkhead
line in Indian Creek in said city described as follows :
Begin at the Northwest corner of Section 23, Township 53
South, Range 42 East of the Tallahassee Meridian, thence
run South 0°0'0" East 718.50 feet to a point; thence run
South 80°26 '00" East 1696.24 feet across Indian Creek to
the Northwesterly corner of Lot 23, Indian Beach Corpora-
tion 's Subdivision recorded in Plat Book 8 at Page 61
of the Public Records of Dade County, Florida . Thence
run North 80°26 '00" West 137.00 feet to the Point of
Beginning of the Bulkhead Line described as follows:
From said Point of Beginning run North 12°01 ' 30" East
502.82 feet to the Point of Curvature of a curve of
2083.103 feet radius deflecting to the Left; Thence run
Northerly along the arc of said curve, parallel to and
161 feet Westerly of the Easterly line of Collins Avenue,
746.71 feet to a Point of Tangency, said arc subtending
a central angle of 20°33 '00" ; Thence run North 8031130"
West along the tangent to the last described curve
251 .657 feet to the Point of Curvature of a Curve of
1892.00 feet radius deflecting to the Right;
Thence run Northerly along the arc of said curve, parallel
to and 161 feet Westerly of the Easterly line of Collins
Avenue, 636 .27 feet to a Point of Tangency said arc
subtending a central angle of 19°17'00"; Thence run
North 10045130" East along the tangent to the last
described curve 100.00 feet to a point; Thence run North
10°18 ' 58" East 900.03 feet to a point, said point being
the end of the Bulkhead Line herein described, said point
also lying on the Westerly productions of the Northerly
Line of Lot 231 of Amended First Ocean Front Subdivision
recorded in Plat Book 9 at Page 78 of the Public Records
of Dade County, Florida, 278.00 feet N. 79°14 ' 30" West
from the Northwest corner of said Lot 231 .
AND, WHEREAS, the Trustees of the Internal Improvement Fund
have examined the bulkhead line as submitted and find it to be
located and properly established according to the provisions of
Section 253.122, Florida Statutes;
NOW, THEREFORE, BE IT RESOLVED BY THE TRUSTEES OF THE
INTERNAL IMPROVEMENT FUND OF THE STATE OF FLORIDA that the
bulkhead line passed and adopted by Resolution No . 10598
on the 21st day of July, 1961, by the City Council of the
City of Miami Beach, Dade County, Florida, be formally approved
and adopted for the purposes prescribed by Section 253,122
Florida Statutes, to remain effective until altered or invali-
dated in accordance with the Law.
DONE AND ORDERED this 11th day of February, 1963, pursuant
to action of the Trustees of the Internal Improvement Fund in
regular meeting on JANUARY 29, 1963 .
