RESOLUTION NO. 10632
WHEREAS, by the terms of that certain Plat entitled 3rd Revised
Plat of Sunset Islands, recorded in Plat Book 40 at Page 8 of the Public
Records of Dade County, Florida, there was dedicated to the perpetual use
of the Public rights of way for storm sewers and drains over the following
described lands, to wit :
The westerly Five (5) feet of Lot 1, Block 1-E, and
the easterly Five (5) feet of Lot 12, Block 1-H, said
3rd Revised Plat of Sunset Islands.
and
WHEREAS, the owners of said lands have requested the City of
Miami Beach to relinquish and surrender all rights conferred upon or granted
to said City by virtue of said Plat as to the lands hereinbefore described,
and
WHEREAS, said owners have offered, in consideration of such
relinquishment and surrender, to grant to the City of Miami Beach the
perpetual right and easement to lay and maintain storm sewers underground
in the following described lands, situate, lying and being in Dade County,
Florida, to wit :
BEGIN at the intersection of Lots 11 and 12, Block 1-H
and the northerly line of North View Drive as shown on
the 3rd Revised Plat of Sunset Islands recorded in Plat
Book 40, Page 8 of the Public Records of Dade County,
Florida, thence run northerly on a straight line a dis-
tance of 226.511 ' to a point on the face of the bulk-
head, said point being 29 . 74' easterly of the westerly
line of said Lot 12, thence run easterly along the face
of the bulkhead a distance of 10 ' more or less, thence
run southerly along a straight line, said line being
parallel to and 10 easterly of the aforesaid straight
line a distance of 226.511 ' to the northerly line of
North View Drive, thence westerly along the northerly
line of North View Drive a distance of 10 ' more or less,
to the Point of Beginning
and --
WHEREAS, the City Attorney has prepared and submitted instru-
ments for execution by said City accomplishing the exchange of easements
as above set forth,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Miami Beach, Florida, that the Mayor and the City Clerk be, and they are
hereby authorized and directed to execute said instruments in the name of
and on behalf of said City.
BE IT FURTHER RESOLVED that the City Attorney be, and he is
hereby authorized and directed to deliver said executed instruments if,
as and when there has been delivered to him a good and sufficient grant
unto the City of Miami Beach, Florida, of a perpetual easement over,under
and across that portion of Lot 12, Block 1-H, 3rd Revised Plat of Sunset
Islands described above,
PASSED AND ADOPTED this 4th day of October, A.D,1961.
