SUBJECT: Red Tide
At the October 17' 2018 City Commission meeting, Commissioner Gongora sponsored
Agenda item R9O, co-sponsored by Commissioner Rosen-Gonzalez, a discussion
looking to hold the Governor accountable for his role in the 2018 Red Tide. As a result
of that discussion, the City Commission directed the City Attorney to conduct research
as to the viability of potential litigation against the Governor. Pursuant to that
discussion, the City Attorney's Office has conducted research relating to a possible
lawsuit. Based upon that research, we do not advise bringing this litigation at this time.
We have advised Commissioner Gongora of the details of our research and he concurs
with our advice. If any Commissioner would like to further discuss the details of this
