Resolution 10844 RESOLUTION NO. 10844 WHEREAS, the City Council of the City of Miami Beach, Florida, deems it to be necessary for the welfare of said City and the inhab- itants thereof to acquire, for the purpose of widening Collins Avenue, a public highway in said City which is a part of the State Highway System, those certain parcels of land, situate, lying and being in Miami Beach, Dade County, Florida, and described as follows, to wit: Outlot numbered 1 of First Ocean Front Subdivision, according to the amended plat thereof, recorded in Plat Book 9, page 78 of the public records of Dade County, Florida, which said outlot constitutes a strip of land lying westerly of and opposite to Lot 1 of said subdivision, which said strip of land is bounded on the east by Collins Avenue; on the west by Indian Creek; on the north by the northerly line of said Lot 1 produced westerly to Indian Creek; and on the south by the southerly line of said Lot 1 produced westerly to Indian Creek. AND ALSO Outlots numbered 2 and 3 of First Ocean Front Sub- division, according to the amended plat thereof, recorded in Plat Book 9, page 78 of the public records of Dade County, Florida, which said outlots constitute a strip of land lying westerly of and opposite to Lots 2 and 3 of said subdivion, which said strip of land is bounded on the east by Collins Avenue; on the west by Indian Creek; on the north by the northerly line of said Lot 3 produced westerly to Indian Creek and on the south by the southerly line of said Lot 2 produced westerly to Indian Creek. AND ALSO Outlot numbered 4 and the South 1/2 of Outlot numbered 5 of First Ocean Front Subdivision, according to the amended plat thereof, recorded in Plat Book 9, page 78 of the public records of Dade County, Florida, which said outlots constitute a strip of land lying westerly of and opposite to Lot 4 and the South 1/2 of Lot 5 of said subdivision, which said strip of land is bounded on the east by Collins Avenue; bounded on the west by Indian Creek; bounded on the north by the northerly line of the South 1/2 of said Lot 5 produced westerly to Indian Creek; and on the south by the southerly line of said Lot 4 produced westerly to Indian Creek. AND ALSO Outlot numbered 8 of First Ocean Front Subdivision, according to the amended plat thereof, recorded in Plat Book 9, page 78 of the public records of Dade County, Florida, which said outlot constitutes a strip of land lying westerly of and opposite to Lot 8 of said sub- division, which said strip of land is bounded on the east by Collins Avenue; on the west by Indian Creek; on the north by the north line of said Lot 8 produced westerly to Indian Creek;and on the south by the southerly line of said Lot 8 produced westerly to Indian Creek. AND ALSO Outlot numbered 9 of First Ocean Front Subdivision, according to the amended plat thereof, recorded in Plat Book 9, page 78 of the public records of Dade County, Florida, which said out- lot constitutes a strip of land lying westerly of and opposite to Lot 9 of said subdivision, which said strip of land is bounded on the east by Collins Avenue; on the west by Indian Creek; on the north by the northerly line of said Lot 9 produced westerly to Indian Creek; and on the south by the southerly line of said Lot 9 produced westerly to Indian Creek. AND ALSO Outlots numbered 10, 11 and the South 1/2 of Outlot numbered 12 of First Ocean Front Subdivision, according to the amended plat thereof, recorded in Plat Book 9, page 78 of the public records of Dade County, Florida, which said outlots constitute a strip of land lying westerly of and opposite to Lots 10, 11 and the South 1/2 of Lot 12 of said subdivision, which said strip of land is bounded on the east by Collins Avenue; on the west by Indian Creek; on the north by the northerly line of said South 1/2 of Lot 12 produced westerly to Indian Creek; and on the south by the southerly line of said Lot 10 produced westerly to Indian Creek. AND ALSO The North One-half of Outlot numbered 12 and all of Outlots numbered 13 and 14 of First Ocean Front Subdivision, according to the amended plat thereof, recorded in Plat Book 9, page 78 of the public records of Dade County, Florida, which said out- lots constitute a strip of land lying westerly of and opposite to the North 1/2 of Lot 12 and Lots 13 and 14 of said subdiv- ision, which said strip of land is bounded on the east by Collins Avenue; on the west by Indian Creek; on the north by the north line of said Lot 14 produced westerly to Indian Creek; and on the south by the southerly line of said North 1/2 of Lot 12 produced westerly to Indian Creek. AND ALSO Outlot numbered 19 of First Ocean Front Subdivision, according to the amended plat thereof, recorded in Plat Book 9, page 78 of the public records of Dade County, Florida, which said outlot constitutes a strip of land lying westerly of and opposite to Lot 19 of said subdiNision, which said strip of land is bounded on the east by Collins Avenue; on the west by Indian Creek; on the north by the northerly line of said Lot 19 produced westerly to Indian Creek; and on the south by the southerly line of said Lot 19 produced westerly to Indian Creek. AND ALSO - 2 Outlot numbered 20 of First Ocean Front Subdivision, according to the amended plat thereof, recorded in Plat Book 9, page 78 of the public records of Dade County, Florida, which said outlot constitutes a strip of land lying westerly of and opposite to Lot 20 of said subdivision, which said strip of land is bounded on the east by Collins Avenue; on the west by Indian Creek; on the north by the northerly line of said Lot 20 produced westerly to Indian Creek; and on the south by the southerly line of said Lot 20 produced westerly to Indian Creek. AND ALSO Outlots numbered 21 and 22 of First Ocean Front Subdivision, according to the amended plat thereof, recorded in Plat Book 9, page 78 of the public records of Dade County, Florida, which said outlots constitute a strip of land lying westerly of and opposite to Lots 21 and 22 of said subdivision, which said strip of land is bounded on the east by Collins Avenue; on the west by Indian Creek; on the north by the northerly line of said Lot 22 produced westerly to Indian Creek; and on the south by the southerly line of said Lot 21 produced westerly to Indian Creek. AND ALSO Outlot numbered 23 of First Ocean Front Subdivision, according to the amended plat thereof, recorded in Plat Book 9, page 78 of the public records of Dade County, Florida, which said out- lot constitutes a strip of land lying westerly of and opposite to Lot 23 of said subdivision, which said strip of land is bounded on the east by Collins Avenue; on the west by Indian Creek; on the north by the northerly line of said Lot 23 produced westerly to Indian Creek; and on the south by the southerly line of said Lot 23 produced westerly to Indian Creek. AND ALSO Outlot numbered 24 of First Ocean Front Subdivision, according to the amended plat thereof, recorded in Plat Book 9, page 78 of the public records of Dade County, Florida, which said outlot constitutes a strip of land lying westerly of and opposite to Lot 24 of said subdivision, which said strip of land is bounded on the east by Collins Avenue; on the west by Indian Creek; on the north by the northerly line of said Lot 24 produced westerly to Indian Creek; and on the south by the southerly line of said Lot 24 produced westerly to Indian Creek. AND ALSO Outlot numbered 26 of First Ocean Front Subdivision, according to the amended plat thereof, recorded in Plat Book 9, page 78 of the public records of Dade County, Florida, which said outlot constitutes a strip of land lying westerly of and opposite to Lot 26 of said subdivision, which said strip of land is bounded on the east by Collins Avenue; on the west by Indian Creek; on the north by the northerly line of said Lot 26 produced westerly to Indian Creek; and on the south by the southerly line of said Lot 26 produced westerly to Indian Creek. - 3 - AND ALSO Outlots numbered 27 and 28 of First Ocean Front Subdivision, according to the amended plat thereof, recorded in Plat Book 9, page 78 of the public records of Dade County, Florida, which said outlots constitute a strip of land lying westerly of and opposite to Lots 27 and 28 of said subdivision, which said strip of land is bounded on the east by Collins Avenue; on the west by Indian Creek; on the north by the northerly line of said Lot 28 produced westerly to Indian Creek; and on the south by the southerly line of said Lot 27 produced westerly to Indian Creek. AND ALSO Outlots numbered 29 and 30 of First Ocean Front Subdivision, according to the amended plat thereof, recorded in Plat Book 9, page 78 of the public records of Dade County, Florida, which said outlots constitute a strip of land lying westerly of and opposite to Lots 29 and 30 of said subdivision, which said strip of land is bounded on the east by Collins Avenue; on the west by Indian Creek; on the north by the northerly line of said Lot 30 produced westerly to Indian Creek; and on the south by the southerly line of said Lot 29 produced westerly to Indian Creek. NOW, THEREFORE, BE IT RESOLVED by the CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, that it is necessary that the fee simple title to the above described property be acquired for use and maintenance for public highway purposes for the benefit of said City and its inhabitants. BE IT FURTHER RESOLVED that the City Attorney and Attorney Ben Shepard be and they are hereby authorized and directed to institute the necessary legal proceedings in the name of said City in the exercise of its right of eminent domain for the condemnation of said property for said purpose, and to file on behalf of said City a Declaration of Taking, as provided by Chapter 74 of the Florida Statutes, and the disbursing officers of said City and said attorneys be and they are hereby authorized and directed to deposit into the Registry of the Court, out of funds available for such purpose, such sums of money as the Court shall determine will fully secure and fully compensate the persons lawfully entitled to compensation.
