A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, URGING MIAMI-DADE COUNTY TO GRANT THE
MIAMI BEACH COMMUNITY DEVELOPMENT CORPORATION (MBCDC) A 90-
DAY STAY FROM FORECLOSURE PROCEEDINGS TO PROVIDE THE MBCDC
BOARD OF DIRECTORS AN OPPORTUNITY TO STABILIZE THE
ORGANIZATION; AND DIRECTING MBCDC TO PRESENT TO THE CITY
COMMISSION, DURING THE STAY, A PLAN OF ACTION TO STABILIZE THE
ORGANIZATION; AND, FURTHER, DIRECTING THE CITY ADMINISTRATION TO
BECOME ACTIVELY INVOLVED IN THIS PROCESS, INCLUDING KEEPING THE
CITY COMMISSION APPRISED OF ALL EFFORTS RELATIVE TO THE PLAN OF
ACTION.
WHEREAS, City Commissioner Kristen Rosen Gonzalez placed an item for discussion
on the October 17, 2018 City Commission meeting agenda to discuss the Miami Beach
Community Development Corporation (MBCDC) and the protection of its affordable housing
assets; and
WHEREAS, the City Commission discussed this item at the October 17, 2018 City
Commission meeting and received input from representatives from MBCDC and Miami-Dade
County (County), MBCDC's largest creditor; and
WHEREAS, Rick Graham, Chief Financial Officer for Miami-Dade County's Department
of Public Housing and Community Development, addressed the City Commission and shared
the County's concerns with the stability of MBCDC's housing portfolio and the condition of its
properties, including the Crespi Park Apartments, and
WHEREAS, Mr. Graham advised that the County has been working with MBCDC to
address these issues for several years without progress or resolution; and
WHEREAS, the County is pursuing legal remedies, available to it pursuant to its funding
agreements with MBCDC, including the foreclosure of those MBCDC properties in which the
County has a financial interest; and
WHEREAS, Mr. Jordan Chisholm, an attorney with Legal Services of Greater Miami,
who represents MBCDC, addressed the City Commission, seeking the City's support in its
efforts to seek a stay of legal proceedings against MBCDC, in order to provide the new board of
directors with an opportunity to stabilize the organization; and
WHEREAS, following a discussion on the matter, the City Commission unanimously
approved a motion to urge the County to provide MBCDC a 90 day stay from foreclosure
proceedings; to require that MBCDC, during the period of the stay, to present to the City
Commission a plan of action to address the County's concerns; and to require the City
Administration to actively participate in the discussions relating to the plan of action, as these
efforts impact our community's elder and low-income residents in the affected properties.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby
urge Miami-Dade County to grant the Miami Beach Community Development Corporation
(MBCDC) a 90-day stay from foreclosure proceedings to provide the MBCDC board of
directors an opportunity to stabilize the organization; and direct MBCDC to present to the
City Commission, during the stay, a plan of action to stabilize the organization; and, further,
direct the City Administration to become actively involved in this process, including keeping
the City Commission apprised of all efforts relative to the plan of action.
