Resolution 10886-A RESOLUTION NO. 10886 A
WHEREAS , by the terms of that certain Plat entitled
Lakeview Subdivision, recorded in Plat Book 14 at Page 42 of
the Public Records of Dade County, Florida, there was reserved
for the use of wire lines , pipe lines , poles , sewers , water
mains , etc. the following described lands , to wit:
The Easterly Five (5) Feet of Lot 11, Block 32
and the Westerly Five (5) Feet Lot 12, Block
32, said Plat of Lakeview Subdivision.
and
WHEREAS , the owners of said lands have requested the
City of Miami Beach to relinquish and surrender all rights con-
ferred upon or granted to said City by virtue of said Plat as
to the lands hereinbefore described, and
WHEREAS , said owners have offered, in consideration of
such relinquishment and surrender, to grant to the City of Miami
Beach the perpetual right and easement to install and maintain
wire lines , pipe lines , poles , sewers , water mains , etc. in the
following described lands , situate, lying and being in Dade
County, Florida, to wit :
The Easterly Ten (10) Feet of Lot 12 , Block
32, Lakeview Subdivision according to the
Plat thereof recorded in Plat Book 14, Page
42 of the Public Records of Dade County,
Florida.
and
WHEREAS , the City Attorney has prepared and submitted
instruments for execution by said City accomplishing the exchange
of easements as above set forth ,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Miami Beach , Florida, that the Mayor and the City Clerk be,
and they are hereby authorized and directed to execute said instru-
ments in the name of and on behalf of said City.
BE IT FURTHER RESOLVED that the City Attorney be, and he
is hereby authorized and directed to deliver said executed instru-
ments if, as and when there has been delivered to him a good and
sufficient grant unto the City of Miami Beach, Florida, of a per-
petual easement over, under and across the Easterly Ten (10) Feet
of Lot 12, Block 32, Lakeview Subdivision.
PASSED AND ADOPTED this 2nd day of January, A.D,1963.
