RESOLUTION NO. 10903
WHEREAS, the City of Miami Beach is now and has been, for
some time, operating and maintaining a metered off the street
parking area on that certain parcel of land situate in Miami
Beach, Dade County, Florida, described as follows, to wit:
Lots 10 and 11, Block 11, OCEAN BEACH ADDITION
NO. 1, according to the plat thereof, recorded
in Plat Book 3, page 11 of the public records of
Dade County, Florida; and
WHEREAS, DADE COUNTY has agreed to construct and maintain
a medical clinic on said land at its own expense, provided the
City of Miami Beach will sell said land to said County for the
sum of One Dollar; and
WHEREAS, the City Council of said City realizes that such a
clinic would be of great beneficial value to its citizens and it
therefore behooves said City to aid the project; and
WHEREAS, the said parking area constitutes a very small part
of the Parking System of the City and the City has heretofore
acquired additional parking areas of far greater value which may
be substituted for said parcel of land; and
WdEREAS, the City Council of the City of Miami Beach, Florida,
deems it to be to the best interest of said City to convey said
land to said County for the sum of One Dollar, provided, however,
that the conveyance will contain a provision whereby the title to
said land shall revert to and become the property of the City of
Miami Beach should Dade County fail to construct a medical clinic
on said land within one year or should the County at any time fail
to use said land for said purpose or use the same for any purpose
other than as a medical clinic and for the parking of automobiles
in connection therewith and shall contain a provision against the
sale, lease or other disposal of said land by said County without
first having obtained the written authority of said City for such lease,
sale or other disposal; and
WHEREAS, the Attorney for the City has prepared and submitted
a warranty deed conveying said land to said County, which contains
said provisions, with the terms of which the City Council is
familiar;
NOW, THEREFORE, BE IT RESOLVED by the CITY COUNCIL OF THE CITY
OF MIAMI BEACH, FLORIDA, that the Mayor and the City Clerk be
and they are hereby authorized and directed to execute said warranty
deed in the name of and on behalf of said City and the City Manager
be and he is hereby authorized to deliver said warranty deed to said
County upon the terms hereinbefore set forth.

RESOLUTION NO. 11113
RESOLUTION ACCEPTING DEED FROM
CITY OF MIAMI BEACH COVERING
SITE FOR HEALTH CLINIC TO BE
CONSTRUCTED BY DADE COUNTY
WHEREAS, Dade County proposes to construct, operate and
maintain a medical clinic to be Located in the City of Miami Beach;
and
WHEREAS, pursuant to Resolution No. 10903, adopted by the
City Council of the City of Miami Beach, that City for the nominal
consideration of one dollar has delivered to Dade County its duly
executed Warranty Deed dated January 17, 1963, conveying certain
land to Dade County as a site to be used for the construction and
operation of such a medical clinic and related parking facilities, said
land being described as:
Lots 10 and 11, Block 11, Ocean Beach
Addition No. 1, according to the plat
thereof, recorded in Plat Book 3, page
11 of the public records of Dade County,
Florida.
AND WHEREAS, said deed is subject to the zoning ordinances
of the City of Miami Beach and contains the following restrictive
provisions and reverter clause:
"This conveyance is made in order that Dade
County may construct and thereafter maintain and
operate a medical clinic on said land hereby
conveyed and should Dade County fail to construct
such clinic within one year from the date hereof or
should Dade County at any time cease to use said
land for said purpose, or use the same for any
purpose other than as a medical clinic and for the
parking of automobiles in connection therewith,

then and in any of such events, all right, title
and interest in and to the demised premises
shall revert to and become the property of the
City of Miami Beach and the legal title thereto
shall immediately be re-vested in the City of
Miami Beach.
The land hereby conveyed shall not be sold,
leased or otherwise disposed of by the grantee
herein without first having obtained the written
authorization by the City of Miami Beach to make
such sale, lease or other disposal. "
WHEREAS, the County Manager has recommended that said
Warranty Deed be accepted;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF
COUNTY COMMISSIONERS OF DADE COUNTY, FLORIDA, that this
Board hereby accepts that certain Warranty Deed dated January 17,
1963 from the City of Miami Beach conveying to Dade County the land
hereinabove described and the Director of the Department of Public
Works is hereby directed to record said Warranty Deed in the public
records of this County.
The foregoing Resolution was offered by Commissioner alempui
B. ilpeet , who moved its adoption. The motion was seconded
