Resolution 10983 RESOLUTION NO. 10983
BE IT RESOLVED that the City Council of the City of
Miami Beach, Florida, be and it is opposed to House Joint Resolu-
tion No. 1283, authorizing the Legislature to enact legislation
affixing municipal liability "in tort" , for the reason that the
rights of the public are now and have been adequately safeguarded
by existing law; that the proposed amendment would authorize the
extension and imposition of municipal liability for such torts as
libel, slander, trespass vi et armis, false arrest, false
imprisonment, assault and battery, and other torts not founded
upon negligence, and that the extension of such tort liability to
municipalities would result in the extinction by bankruptcy of
municipal government as the same has been known through the
centuries, and
BE IT FURTHER RESOLVED by the City Council of the City
of Miami Beach, Florida, that each Senator and member of the
House of Representatives representing Dade County be earnestly
exhorted to render all aid to defeat said House Joint Resolution
No. 1283 .
